Reciprocal Agreement Between Homeowner’s Associations

referred to herein as (Alpha) , and ____________________________ (Name of Homeowner’s
Association) , a nonprofit corporation organized and existing under the laws of the state of
_________________, with its principal office located at ________________________________
____________________________________ (street address, city, county, state, zip code) ,
referred to herein as Beta .
For and in consideration of the mutual covenants contained in this agreement, and other
good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged,
the parties agree as follows:
1. The purpose of this Agreement is to foster good neighbor relations between the Alpha
and Beta communities. This Agreement will continue in effect indefinitely; however, any
portion of this Agreement may be modified, amended or canceled by a majority vote of
either Board of Directors of Alpha or Beta upon (thirty) 30 days written notice to the other Board
of Directors.
2. This Agreement is between Alpha and Beta for the benefit of their respective
homeowners. For the purpose of this Agreement a guest is an individual who is accompanied by
a homeowner. Renters assume homeowner usage rights when the homeowner formally notifies
the homeowner’s Association and delegates his rights to the renter. Where noted, priority is
given to homeowners of the facility being used (i.e., when Alpha members are using certain
Alpha facilities or amenities, Alpha members have priority for usage; when Beta members are
using certain Beta facilities or amenities, Beta members have priority for usage). Homeowners
are required to show proof of current membership upon request.
3. Arts and Crafts Classes
Arts & Crafts classes are open to all Alpha and Beta homeowners on a space available
basis with priority given to homeowners of the facility being used. Guests are not allowed.
4. Banquets and Private Parties
Alpha and Beta homeowners and their guests may use each other’s facilities for
banquets or private parties. All banquets or private parties in Alpha and Beta facilities require a
homeowner sponsor for the event, with the sponsor being responsible for the reservation
and arrangements, payment of all fees, behavior of guests and any related property damage.
The sponsor must be in attendance at the entire event.
5. Billiard Rooms
Billiard rooms are open to all Alpha and Beta homeowners and their guests on a
space available basis with priority given to the homeowners of the facility being used, and
under terms and conditions set by Alpha and Beta from time to time
6. Bulletin Boards
Each Association provides equal bulletin board space for the other Association’s use
for promoting events and activities sponsored by that Association and its sanctioned clubs.
All material, forwarded from one Association to the other for placement on the receiving
Association’s bulletin board, will be given to the recipient Association’s Recreation/Activity
Director for review, approval, and posting. Both Alpha and Beta reserve the right to review,
reject, or remove any material placed on their respective bulletin boards by the other
Association, and agree to notify that organization of such action.
7. Card and Game Playing in Lounges
Playing of cards and games in Alpha and Beta lounges is restricted to homeowners
and their guests on a space available basis. Alpha reserves the right to permit Beta
homeowners to use Alpha lounge areas for these activities under terms and conditions set by
Alpha from time to time. Beta reserves the right to permit Alpha homeowners to use Beta lounge
areas for these activities under terms and conditions set by Beta from time to time.
8. Card Rooms
Any Alpha or Beta homeowner may use each other’s card rooms on a time/space
available basis with priority given to the homeowners of the facility being used. At least one
player at each table must be from the Association where the card room is located ( i.e., if there
are ten tables being used by card players, at least ten people in the room must be members of
the Association where the card room is located).
9. Lakes and Common Areas
Members of Alpha or Beta may only fish in lakes designated by their own respective
Associations. Only Alpha homeowners may bring pets to Alpha lakes and common areas; only
Beta homeowners my bring pets to Beta lakes and common areas.
10. Meeting Rooms
Meeting rooms can be used by all Alpha and Beta homeowners on a space available
basis, with priority given to homeowners of the facility being used. Each Association requires
that a homeowner of that Association sponsor and be in attendance at any meeting room event.
11. Outdoor Pools
All Alpha and Beta outdoor pools may be used by all Alpha and Beta homeowners
and their guests under terms and conditions that may be set from time to time by the
respective Associations. All Alpha at a Beta pool must be accompanied by an Alpha
homeowner; all Beta guests at an Alpha pool must be accompanied by a Beta homeowner.
12. Social Events
Social events are open to all Alpha and Beta homeowners. The sponsoring
Association may impose priority in the form of advanced or restricted ticket sales or price
differentials for special events.
13. Tennis Courts
Alpha and Beta tennis courts are open to all Alpha and Beta homeowners. Beta
homeowners and guests may play on Alpha courts and Beta homeowners and guest may play
on Alpha courts during open play time, as long as one player per singles and two players per
doubles are homeowners of the Association where the courts are located.
14. Nonreciprocal Facilities and Amenities
Both Alpha and Beta have facilities and amenities that are not reciprocal in nature but
are available for use by homeowners of both communities, under the terms and conditions set
forth by the Association where the facility or amenity is located. The following are nonreciprocal
facilities and amenities that are available for use by Alpha and Beta homeowners:
A. Golf Course Facilities
Since Beta does not currently own these facilities, it is not feasible for Alpha to
enter into a reciprocal agreement dealing with golf course facilities. Alpha reserves the
right to permit usage of the _______________________ (Name) Courses by Beta
homeowners under terms and conditions set by Alpha from time to time.
B. Golf Driving Range, Chipping Green, and Putting Greens
Alpha golf driving range, chipping green, and putting greens are restricted to
Alpha homeowners only, except for those Beta homeowners who have purchased an
Alpha golf annual membership or who have paid a daily green fee.
C. Fitness Centers
Since Beta does not currently own these facilities, it is not feasible for Alpha to
enter into a reciprocal agreement dealing with fitness facilities. Beta members may use
the Alpha Fitness Center for an individual annual fee that is equal to the individual
annual fee for the fitness center that is located within the Beta perimeter.
D. Racquet Ball
Since Beta does not currently own this type of facility, it is not feasible for Alpha
to enter into a reciprocal agreement dealing with the racquet ball facilities. Alpha
reserves the right to permit Beta homeowners and their guests to use the Alpha racquet
ball facilities on a space/time available basis with priority given to Alpha members and
guests, and under terms and conditions set by Alpha from time to time.
E. Park
Since Beta does not currently own this type of facility, it is not feasible for Alpha
to enter into a reciprocal agreement with Beta dealing with Beta and including its
amenities. Alpha reserves the right to permit usage of the Alpha Park by Beta
homeowners on a space available basis under terms and conditions set by Alpha from
time to time, and as specified in the Board Policies of this Alpha Facility. However, Alpha
homeowners shall have priority in reserving and using the Park and its amenities.
F. Baseball Field
Since Alpha does not currently own this type of facility, it is not feasible for Beta
to enter into a reciprocal agreement dealing with the baseball field. Softball Association
members may use the softball field subject to the terms and conditions of the Softball
Association and Beta .
15. In this Agreement, the singular includes plural and masculine includes feminine.
The signatures below acknowledge that the Boards Alpha and Beta have voted to
accept the terms of this Agreement.
