For and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. This contract constitutes permission from Owner to Sitter to enter Owner’s address set forth above (the House ), and perform the hereinafter described house sitting duties. 2. This contract constitutes the express permission of Owner for Sitter to accept telephone calls, reservations for service, mail, and come and go from the House without any additional written authorization. 3. Sitter agrees to provide services stated in this contract in a reliable and trustworthy manner. In consideration of these services and as an express condition thereof, Owner expressly waives any and all claims for damages against Sitter (unless arising from intentional misconduct or gross negligence on the part of Sitter) with regard to the following: A. Damage to lawn, plants, or any outside furniture; B. Damage to indoor or outdoor plants; C . The loss of any trash or recycle receptacles due to wind or any act of nature; or D. Damage to House of any nature. 4. In case of an emergency such as a fire, water leak, or gas leak, Sitter has the right to arrange for qualified persons to fulfill contract responsibilities for repairs. Sitter will notify Owner as soon as possible of the emergency. 5. No pet sitting will be provided for in this contract. If pet setting is needed, a separate contract or an amendment to this contract must be executed by both parties. 6. Owner hereby authorizes Sitter to immediately deal with any emergencies that may arise in the manner that Sitter deems most effective in protecting life and property. An emergency is defined as a sudden, urgent, usually unexpected occurrence or occasion requiring immediate action.7. This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of ____________________________. 11. Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. 12. This Agreement shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding upon either party except to the extent incorporated in this Agreement. 13. Any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by each party or an authorized representative of each party. 14.
