FINDINGS The court FINDS: 2.1 Adequate service has been effected on:  Mother  Legal Guardian  Father  Other 2.2 Indian status:  The child is not Indian as defined in 25 U.S.C. 1903(4), and the Indian Child Welfare Act does not apply to these proceedings. All notice requirements and evidentiary requirements under the Indian Child Welfare Act have been satisfied, as follows: 2.3  The following allegations are established by clear, cogent and convincing evidence. (a) The child has been found to be a dependent child. (b) A dispositional plan has been entered pursuant to RCW 13.34.130. (c) The child has been removed, or will, at the time of the hearing, have been removed from the custody of the parent for a period of at least six months pursuant to a finding of dependency. (d) The services ordered under RCW 13.34.136 have been expressly and understandably offered or provided and all necessary services reasonably available, capable of correcting the parental deficiencies within the foreseeable future have been expressly and understandably offered or provided. (e) There is little likelihood that conditions will be remedied so the child can be returned to the parent in the near future. (f) The continuation of the parent and child relationship clearly diminishes the child's prospects for early integration into a stable and permanent home. 2.4  Pursuant to RCW 13.34.190(1)(b), the following findings are waived: (1) that the child has been removed or will, at the time of the hearing, have been removed from the custody of the parent for a period of at least six months pursuant to a finding of dependency under RCW 13.34.030; and (2) that the services ordered under RCW 13.34.136 have been expressly and understandably offered or provided and all necessary services reasonably available, capable of correcting the parental deficiencies within the foreseeable future have been expressly and understandably offered or provided, and:  The following allegations are established beyond a reasonable doubt. (a) The child has been found to be a dependent child under RCW 13.34.030. (b) A dispositional plan has been entered pursuant to RCW 13.34.130. (c) There is little likelihood that conditions will be remedied so the child can be returned to the parent in the near future. HRG/FIND/ORD TERM PARENT-CHILD REL (ORTPCR) - Page 2 of 4 WPF JU 04.0110 (6/2004) - RCW 13.34.190 - .210 (d) The continuation of the parent and child relationship clearly diminishes the child's prospects for early integration into a stable and permanent home; or In determining whether (c) and (d) are established beyond a reasonable doubt, the court considered and found that the following aggravated circumstances listed in RCW 13.34.132, existed: ___________________________________________ _________________________________________________________________ _________________________________________________________________ _________________________________________________________________  It is established beyond a reasonable doubt that the child was abandoned, as defined in RCW 13.34.030. 2.5  It is established beyond a reasonable doubt that the child was found under such circumstances that the whereabouts of the child's parent are unknown and no person has acknowledged paternity or maternity and requested custody of the child within two months after the child was found. 2.6  It is established beyond a reasonable doubt that the child has been found to be a dependent child under RCW 13.34.030 and that the parent has been convicted of the following crime(s) listed in RCW 13.34.180(3):   murder in the first degree,  murder in the second degree, or  homicide by abuse as defined in Chapter 9A.32 RCW against another child of the parent;   manslaughter in the first degree or  manslaughter in the second degree, as defined in Chapter 9A.32 RCW against another child of the parent;  attempting, conspiring, or soliciting another to commit one or more of the crimes listed above; or   assault in the first or  second degree, as defined in Chapter 9A.36 RCW, against the surviving child or another child of the parent. 2.7 An order terminating the parent-child relationship is in the best interest of the child. 2.8  Other: _________________________________________________________________ _______________________________________________________________________ _______________________________________________________________________ _______________________________________________________________________ _______________________________________________________________________ III. ORDER IT IS ORDERED that: 3.1 All rights, powers, privileges, immunities, duties and obligations, including any rights to custody, control, visitation or support existing between ________________________________________ (parent's name) and _________________________________________ (child’s name) are severed and terminated and the parent shall have no standing to appear at any further legal proceedings concerning the child. 3.2 Any support obligation existing prior to the effective date of this order remains in full force and effect.
