IN THE COURT OF COUNTY, VS. NO. COMPLAINT TO MODIFY CHILD CUSTODY, CHILD SUPPORT, ALIMONY AND RELATED RELIEF The parties are: (a) , Plaintiff. (b) , Defendant. I. The parties were previously divorced by the Court of County, in the above referenced cause number and as such, said Judgment is incorporated herein by reference. II. The Plaintiff would show that there has been a material change in circumstance in that the minor child of the parties now physically resides in County, 3 with his/her fathe r, by the consent and agreement by the minor child and his/her mother, therefore, the fat her is entitled to the legal and physical custody of the minor child. The mother has been sending some support by voluntary agreement directly to the minor child. IV. Additionally, there has been a material change in circumstance in the Defe ndant's earning capacity and paragraph 11 should be modified to terminate or reduce Plaintiff's obligation t o pay periodic alimony. WHEREFORE, PREMISES CONSIDERED, the Plaintiff prays for the following relief: (a) Exclusive care, custody and control of the minor child of the parties; (b) Defendant to pay unto Plaintiff a reasonable amount as child support; (c) Modify paragraphs 7, 8, 9, and 10 of the Judgment of Divorce based on the aforementioned facts; (d) Modify paragraph 11 of the Judgment of Divorce to terminate or in the alternative reduce Plaintiff's obligation to pay periodic alimony; (e) Defendant to pay unto Plaintiff a reasonable amount as attorney fees and costs of court; Plaintiff prays for general relief.
