IN THE CHANCERY COURT OF COUNTY, MISSISSIPPI EX PARTE , A MINOR, BY AND THROUGH , MOTHER AND NEXT FRIEND ORDER TO ALLOW THE WITHDRAWAL OF FUNDS THERE CAME ON FOR HEARING THIS DAY the sworn Petition of , and , as father/mother and next friend of , a minor, who moves the Court to allow a withdrawal of funds currently held at Bank for the use and benefit of the . The court having considered said Petition, and having heard and considered the matter, finds that it has jurisdiction of the parties hereto and the subject matter herein, and the Court further finds as follows: 1. On , , this Honorable Court entered an Order Authorizing the Settlement of a Small Claim on behalf of by and through his/her father/mother and next friend, . A true and correct copy of said Order is in the Court file in this matter, and is incorporated herein as though fully set forth in words and figures. 2. Said Order was entered pursuant to a settlement regarding a motor vehicle accident in which was a passenger and suffered injuries as a result of said accident. 3. In said Order, the funds in the amount of $ were not placed in a guardianship for    , but were ordered to be held on deposit at Bank until further order of this Court. 4. Pursuant to the Order entered on , , Bank entered an Acknowledgment of Receipt of Certified Copy of the Order for Deposit and Receipt of Cash Funds. A true and correct copy of said Acknowledgment is in the Court file in this matter, and is incorporated herein as though fully set forth in words and figures. 5. A recent high school graduate is currently years of age and is need of the funds on deposit at such that he/she can purchase an automobile for his/her use and apply the remainder of the funds towards his/her education at . 6. Petitioners have had to employ counsel, of the law firm in an effort to expedite this matter, and it is their desire that counsel be reimbursed from said funds in the amount of $ plus expenses. 7. Petitioners have prayed that this Court dispense with a final accounting in this matter, as all funds will be used for the purposes herein stated. IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED, that Bank is hereby authorized to allow Petitioners to withdraw all funds currently held for the use and benefit of from Bank and disburse them to such that he/she may use said funds to purchase an automobile for his/her use and benefit, and to pay any reasonable and necessary expenses for him/her to attend .
