Petitioner is, and at all times mentioned was, a resident of ___________________ ______________________________________________________________________________ ________________________________________ (street address, city, county, state, zip code) and is the surviving spouse of the Decedent, _________________________________________ . 2. _______________________________________________________, Respondent, is, and at all times mentioned was, a corporation, organized and existing under the laws of ____________________________________________________________ (state) , with its principal place of business located at ________________________________________________ ______________________________________________________________________________ _____________________________________ (street address, city, county, state, zip code), and engaged in and transacting the business of a cemetery in ________________________________ _____________________________________________________________ (city, county, state). The cemetery is known as __________________________________________ Cemetery. 3. Decedent died on _________________________________ ( date) in ______________________________________________________________________________ ___________________________ (city, county, state), and was buried in Respondent's cemetery. 4. At all times mentioned, until his death, Decedent was the owner of a plot of land in Respondent's cemetery designated as Plot No. ______, Section _______, containing _________________ ( number of square feet) , on which plot of land is erected a mausoleum in which Decedent is buried. 5. Petitioner desires to remove the body of Decedent from the mausoleum in the above-named cemetery and to transfer and reinter the body in Petitioner's family plot also located in Respondent's cemetery, which plot of land was also owned by Decedent, and is located near the plot of land on which the mausoleum is erected, and which plot is designated as Plot No. _______, Section ______, containing _________________ ( number of square feet) , which is sufficient space for ____________ (number) graves . 6. On _________________________________ (date) , Petitioner requested Respondent to allow the removal of Decedent's body in the manner alleged in Paragraph 5, and presented Respondent with the signed consent to the removal and reinterment made by Petitioner and the children of Decedent, who are all above the age of 21, but Respondent refused and still refuses to allow Petitioner to remove and reinter Decedent's body. Written notice of this Petition was duly given to Respondent on _______________________________ (date) . A copy of the said notice is attached as Exhibit A, and incorporated by herein by reference. 7. Petitioner, as the surviving spouse of Decedent, and the said children of Decedent, have all consented in writing to the removal of Decedent's body as requested in this Petition. A copy of said consent is attached hereto as Exhibit B and incorporated by herein by reference. 8. A list of the names and addresses of said children of Decedent is attached hereto as Exhibit C and, along with Petitioner, constitute all persons interested in this proceeding. 9. The relief requested in this Petition should be granted so that Petitioner's family will be together in death as they were in life. 10. No previous petition has been made for the relief sought in this Petition.
