Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement with Regard to Hiking in State or National Park BY SIGNING THIS RELEASE AGREEMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT PLEASE READ CAREFULLY ! Release executed on the ___ day of __________, 20____ by _____________________ who resides at __________________________________________ (street address, city, county, zip) in favor of ________________________________ doing business at __________________________________________ (street address, city, county, zip), hereafter referred to as “Guide,” and the ___________________ Lodge, located at __________________________________________ (street address, city, county, zip), hereafter referred to as “Lodge.” I, _____________________, hereby acknowledge that I am a guest of the Lodge and have voluntarily applied to participate in a hike on the ___ day of __________, 20____, (hereafter referred to as “the Hike”) to be led by Guide in the _________________________ National Park, hereafter referred to as “Park.” I am aware that hiking in the Park is a hazardous activity, and that I am voluntarily participating in this activity with the knowledge of the dangers involved and I hereby agree to accept any and all risks of injury and death . For and in consideration of being permitted by Guide and Lodge to participate in the Hike, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I hereby agree that I, my heirs, legal representatives and assigns will not make a claim against, sue, or prosecute either Guide or Lodge for injury or damage resulting from the negligence or other acts, howsoever caused, by any employee, agent or contractor of either Lodge or Guide, as result of my participation in the Hike. In addition, I hereby release and discharge Guide and Lodge from all actions, claims or demands that I, my heirs, legal representatives or assigns now have or may hereafter have for injury or damage resulting from my participation in the Hike. I have carefully read this agreement and fully understand its contents. I am aware that this is a release of liability and a contract between and among the undersigned, Guide and Lodge, and I have signed it of my own free will.
