Rent Lessee agrees to pay as rental for the Premises $____________ per month, payable, without demand, in advance on the _____day of each month. The first and last months' rental shall be paid on the execution of this lease agreement. 2. Furnished Apartment On execution of this agreement, Lessee shall deposit with Lessor the additional sum of $____________, as security for the full and faithful performance by Lessee of this agreement, $____________of which security deposit shall be refundable on the expiration of the tenancy, provided this agreement has been complied with in all aspects by Lessee. 3. Furnishings The subject apartment is leased as a furnished unit containing the items of household furniture, kitchen utensils, and other household items listed in Schedule A attached to and made a part of this lease agreement. No furnishings or other household items are furnished or leased with the unit other than those listed in that Schedule. Lessee agrees to return all items listed in the Schedule to Lessor on the expiration of the tenancy in as good condition as when received, reasonable wear and tear excepted. Lessee, by the execution of this agreement, accepts all items listed in the Schedule as being in good, serviceable condition. Lessee will be responsible for all breakage or other damage to items listed. 4. Utilities__________________ (Lessor or Lessee) shall pay for all water supplied to the Premises and for regular waste removal. Except as otherwise provided in this lease agreement, Lessee shall pay for all gas, electricity, telephone service, and other utilities supplied to the Premises. 5. Occupancy Lessee agrees that the Premises shall be occupied by no more than ______ (number) persons, consisting of _______ (number) adults and _______ (number) children without the written permission of Lessor. Lessee shall not keep or permit to be kept on the Premises any animal, bird, or other pet without Lessor's prior, express, and written consent. 6. Right of Entry Lessor reserves the right to enter the Premises at all reasonable hours for the purpose of inspection and whenever necessary to make repairs and alterations to the Premises. Lessee grants permission to Lessor to show the Premises to new rental applicants at reasonable hours of the day, within ________ (number) days of the expiration of the tenancy. 7. Assignment and Subletting Lessee shall not sublet the Premises, or any part of the Premises, or assign this lease agreement without Lessor's prior, express, and written consent. 8. Default Any failure by Lessee to pay rent or other charges promptly when due or to comply with any other term or condition of this lease agreement shall, at the option of Lessor, promptly terminate this tenancy and forfeit all rights of Lessee under this lease agreement. 9. Maintenance and Redelivery of Premises Lessee shall keep and maintain the Premises in a clean and sanitary condition at all times, and on the expiration or earlier termination of the tenancy shall surrender the Premises to Lessor in as good condition as when received, ordinary wear and tear and damage by the elements excepted. 10. Duty to Repair Lessor shall put the Premises into a condition fit for their occupation by the commencement of the tenancy and shall make all necessary repairs of the Premises that may render them untenantable, except that Lessee shall repair all deterioration or damage to the Premises caused by his/her lack of reasonable care. No duty on the part of Lessor shall arise with respect to repairs for tenantability under this Section, however, if Lessee is in substantial violation of any one or more of the following affirmative obligations: A.To keep the demised Premises clean and sanitary as their condition permits. B. To remove from the dwelling unit all rubbish, garbage, and other waste, in a clean and sanitary manner. C.To properly use and operate all electrical, gas, and plumbing fixtures and keep them as clean and sanitary as their condition permits. D. To not allow any person on the Premises with Lessee's permission, to willfully or wantonly destroy, deface, damage, impair, or remove any part of the structure or dwelling unit or the facilities, equipment, furnishings, or appurtenances, or himself/herself do any such thing. E. To occupy the Premises as a personal residence, using the portions of the Premises for living, sleeping, cooking, or dining purposes only which were respectively designed or intended to be used for such occupancies. 11. Effect of Holding Over The parties agree that any holding over by Lessee under this agreement, without Lessor's written consent, shall be a tenancy at will which may be terminated by Lessor on ____ (number) days' notice in writing. 12. Termination This agreement and the tenancy granted and created by it may be terminated at any time by either party giving to the other party not less than _____ (number) days' prior written notice. 13. Indemnification Lessee shall indemnify, defend, and hold lessor harmless from any and all claims and damages (including reasonable attorney's fees and costs) arising from Lessee's use of the Premises or from any activity permitted by Lessee in or about the Premises unless caused by Lessor. In case any action or proceeding shall be brought against Lessor by reason of any such claim, Lessee, on notice from Lessor, shall defend it at Lessee's expense by counsel approved in writing by Lessor. 14. Notices All notices under this lease agreement shall be in writing and shall be effective when mailed by certified mail, return receipt requested, to their addresses set forth above (or to Lessee at his/her apartment address) or to such other addresses as may be designated by notice, or when delivered personally to Lessor or Lessee 15. Mandatory Arbitration Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. 16. Governing LawThis lease agreement shall be governed by, construed, and enforced in accordance with the laws of ________________________________ (state). 17.
