Rental, Release and Indemnity Agreement Given by Customer in Favor of Equipment Supplier for Pole Dancing Parties Whereas, _________________________________ (Name of Equipment Supplier) of ______________________________________________________________________________ ________________________________________________ (street address, city, state, zip code) , hereinafter called Supplier , provides poles and other equipment for pole dancing parties and other recreational purposes; and Whereas, the undersigned ________________________________ (Name of Customer) , hereinafter called Customer , desires to rent from Supplier a suitable pole and other equipment (said pole and equipment being hereafter jointly referred to as the Equipment ) ; and Whereas, Customer will be renting Equipment for a pole dancing party to be held at ______________________________________________________________________________ ___________________________________________ (street address, city, state, zip code) , and Now, therefore, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Customer acknowledges that Customer has been instructed in and fully understands the safe operation of the Equipment and agrees to observe all safety precautions. On the execution of this agreement, Customer shall deposit with Supplier $____________ as security for the faithful performance by Customer of the terms and conditions of this agreement. If Customer fully complies with the terms and conditions, the deposit shall be refunded to Customer upon return of the Equipment . Should Customer fail to comply with any of the terms, such deposit may be applied by Supplier to the payment of the costs and expenses, including attorney's fees, incurred by Supplier because of such default. Customer agrees to pay Supplier , on return of the Equipment, for all charges incidental to breakages or damage, ordinary wear and tear excepted, to the Equipment during the term of this agreement. 5. Customer acknowledges that Equipment is of a size, design, capacity, and manufacture selected by Customer . Supplier has not made and does not make any representation, warranty, or covenant, express or implied, with respect to the condition, quality, durability, or suitability of the Equipment . 6. Customer shall indemnify Supplier against, and hold Supplier harmless from, any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including attorneys fees, arising out of, connected with, or resulting from the Equipment or this lease, including without limitation, the manufacture, selection, delivery, leasing, renting, control, possession, use, operation, maintenance or return of the Equipment. Customer shall further indemnify Supplier , and hold Supplier harmless, from all loss and damage to the Equipment during the rental period. Customer recognizes and agrees that included in this indemnity clause, but not by way of limitation, is Customer’s assumption of any and all liability for injury, disability and death of person caused by the operation, use , control, or handling of the Equipment during the term of this lease. 7. This Agreement shall be governed by the laws of the State of _________________and the parties agree that any legal action relating to or arising out of this agreement shall be brought exclusively in binding arbitration in ____________________________________ (city, state) and subject to the Rules of the American Arbitration Association.
