Fill and Sign the Sale for Warranty Form

Bill of Sale for a Stallion with a Warranty of Breeding Capacity I, ___________________________ of _________________________________ ___________________________________ (street address, city, county, state, zip code) , in consideration of $____________ to me by ___________________________ , a corporation organized and existing under the laws of the state of ______________, with its principal office located at ______________________________________________________ (street address, city, county, state, zip code) the receipt of which is acknowledged, do now sell to ___________________________ , the following-described stallion: ______________________________________________________________________________ ______________________________________________________________________________ (description of stallion) . I warrant that I am the lawful owner of the above-described stallion; that the animal is free from all encumbrances; that I have the right to sell the stallion; and that I will warrant and defend the same against the lawful claims and demands of all persons. I further warrant that the above-named stallion is in good health, and covenant that if any mares bred to the stallion, in conformity with accepted horse breeding practices in ___________________________ (county & state , do not get with foal when regularly returned, then on return of the stallion to me at the above stated address, during ___________________________ (e.g., the first week of the month) next following the full service season concluded after the date of this bill of sale in good health and condition, that I will furnish the purchaser named in this bill of sale , without further charge, another pure bred stallion of equal quality for breeding services, for the consideration named in this bill of sale . I provide, as a condition to this warranty, that the tally sheet that accompanies and is delivered with this bill of sale shall be accurately filled out, with the date of each service and trial, and sufficient identification of all mares bred, and after being so filled out, shall be returned to me at ______________________________________________________ (street address, city, county, state, zip code) , by registered mail, not later than _________________ (date) . For purposes of this bill of sale , the stallion's full service season shall be considered as of the period commencing _____________ (date) and ending ________________ (date) . Should the conditions of this bill of sale not be faithfully performed, time being of the essence, or should the stallion become injured or disabled through accident or disease after its delivery to the purchaser named in this bill of sale without fault of the undersigned, this warranty shall be null and void and of no effect, and all obligations incurred by the undersigned in this bill of sale shall be considered fulfilled and terminated. This bill of sale contains all the agreements of warranty or guaranty made by the undersigned in the sale of the above-named stallion. The undersigned provides that he shall not be liable for any claim that may, after the date of this bill of sale , be made alleging any verbal agreement of the undersigned, his agent or assigns in the sale of the above-named stallion.
