SALT WATER DISPOSAL LEASE(Maintained by Rentals) This Salt Water Disposal Lease (the “Lease”), is made and entered into thi s _____ day of _____, _____ (the “Effective Date”), between (Name and Address), referred to as the “Lessor,” and (Name and Address), referred to as the “Lessee.” Lessor, for Ten Dollars ($10.00), and other valuable consideration, the receipt of which is acknowledged, demises, leases, and lets to Lessee, its successors or assigns, the following lands located in _____ County, _____, for the purposes provided for in this Lease. (Description of Lands) The lands described may be referred to in this Lease as the “lease premises.” 1. Lessee shall have the exclusive right to use the lease premises and a disposal we ll to be located on the lease premises, in connection with the disposal of oil field brine and other waste water, by Lessee, and their injection into the substrata of the lease premises; and for the digging of pits; for the erection of tanks and receptacles necessary in receiving, treating, and disposing of brine and waste water; and, for the erection of structures, appliances, engines, and machine ry necessary in connection with the operation of the drilled well as a salt water disposal input well. Lessor grants Lessee the right to lay any pipelines as may be necessary or advisable to accomplish the purpose for which this Lease is granted. 2. This Lease shall terminate on the _____ day of _____, _____, unless on or before that date Lessee pays or tenders to Lessor or deposits to Lessor’s credit in the _____ Bank at _____, the sum of _____ Dollars which shall be considered as a rental, continuing the Lease in effect for one year from that date. On like annual payments or tenders, Lessee may continue t he Lease in effect from year to year for a period of _____ years from the Effective Date and so long thereafter as the lease premises are used for salt water disposal. All payments and tenders may be made by draft or check of Lessee deposited in any post office in an envelope with suffic ient postage, addressed to Lessor or the bank named above. No change in the ownership of the lease premises shall be binding on Lessee until and unless it shall have first been furnished a certificate or photostatic copy of the recorded conveyance effecting a transfer of title. 3. Lessee shall have the right to use the lease premises and the disposal well for the injection of oil field brine and waste water into the substrata of the lands, whethe r produced on lands operated for oil and gas by Lessee or those operated by others. 4. Lessee shall have the right, during the term of this Lease or within 90 days after it s termination to remove from the lease premises all materials, equipment, and ot her personal property placed on the lease premises by Lessee. 5. Lessee, in operating the disposal well, shall not inject brine or other waste wa ter into fresh water bearing sands or oil and gas bearing strata underlying the lands. 6. Lessee agrees to conduct its operations in accordance with rules and regulations of the state of __________, or other proper authority having jurisdiction over the operations to be conducted by Lessee on the lease premises. 7. The terms of this Lease shall extend to and be binding on Lessee and Lessor and t heir heirs, successors or assigns.
