STATE OF ALABAMA DEMOLITION AGREEMENT COUNTY OF _________________ This Agreement made this _____ day of ________ ______, between ____________, hereinafter referred to an “Contractor”, and ________________________________, hereinafter referred to as “Owner.”WHEREAS, Owner is the owner of the real property at_________________________, ____________________, _________________ County, Alabama, on which is situated a house (the “Improvements”), and WHEREAS, Owner wishes to have the Improvements removed, razed and demolished to ground level; IT IS THEREFORE AGREED AS FOLLOWS:1.Contractor agrees to provide all labor, materials and equipment necessary to demolish the Improvements to the level of the concrete pad, such work to commence within a reasonable time after the execution of this Agreement and to be completed no later than ________________ (____) working days from the date of the execution of this Agreement.2. Contractor will be responsible to contact all utility companies necessary to provide for the discontinuance and disconnection of service to the property in accordance with the requirements of all authorities having jurisdiction thereof, and shall coordinate all activities connected with the demolition of the Improvements.3.Contractor is to obtain all necessary permits and licenses and pay all fees connected with the demolition and removal of the Improvements and conduct all operations under this Agreement in accordance with the requirements of the respective federal, state and municipal agencies and other authorities having jurisdiction thereof.4. Subject to the provisions hereof, Contractor will remove from the premises all material and debris that result from the demolition of the Improvements, and may either keep for himself, or dispose of all such material, including bricks. Disposal of all materials shall be in full compliance with all laws and regulations of the respective federal, state and municipal agencies and other authorities having jurisdiction thereof, and Contractor agrees to indemnify and hold harmless Owner from any and all liability arising out of removal or disposal of any part of the Improvements.5. The parties acknowledge that the consideration which is the basis of this contract is that the owner will benefit by having the house torn down and removed and the property cleared off, and the Contractor will receive a benefit in that he will be allowed to keep the lumber, bricks, and other materials from the structure which is to be torn down. Other than the aforesaid consideration, no money will be paid to the other by either party. 6.Contractor will indemnify and hold harmless Owner from any liability for personal injury, property damage, penalties or other loss, including incidental and consequential damages, and attorneys fees, that may in any way arise or be caused directly or indirectly out of the performance of this Agreement, including, but not limited to, demolition of the Improvements and removal and disposal of the debris, whether such injuries to persons or damage to property are due or claimed to be due to any negligence or fault of Contractor, Owner, their agents, servants or employees or any other person or persons.IN WITNESS WHEREOF, the parties have executed this Agreement on the day and date first written above.
