Permit Descriptions
CAFRA - A Coastal Area Facility Act permit is required to construct residential, commercial, public, transportation, utility and energy-related
facilities in the coastal area as defined by the Act.
Federal Consistency Activity: Certain federal permits, not limited to the U.S. Army Corps of Engineers Dredge and Fill Permits, require
certification by the DEP prior to the issuance of the permit by the federal agency.
Freshwater Wetlands: A Permit (Letters of Exemption, Letters of Interpretation, Statewide General Permit, Open Water Fill, Individual, Transition
Area Waiver, Water Quality Certificate) is needed prior to engaging in a regulated activity in or around freshwater wetlands and associated
transition areas. A Stream Encroachment Permit, an U.S. Army Corps of Engineers Dredge and Fill Permit, and a Water Quality Certification may
also be required.
General Groundwater Petroleum Products Cleanup: This general permit authorizes the surface water discharge of treated groundwater previously
contaminated with petroleum products.
NJPDES permits: A permit is required for the discharge of pollutants to surface and groundwater, a discharge from an indirect user or the land
application of municipal and/or industrial residuals. (A more comprehensive definition of activities, which require a permit, may be found at
N.J.A.C. 7:14A-2.4)
Solid Waste Facility: A permit is required to conduct or operate any solid waste facility as defined under the Solid Waste Management Act,
N.J.S.A. 13:1E-1 et seq., and N.J.A.C. 7:26-1 et seq.
Stream Encroachment: Under the Flood Control Act DEP is empowered to require a permit to control construction within and proximate to flood
hazard areas to reduce flood damage to and from new development and to protect the flood storage capacity and ecology of flood plains.
Tidal Wetlands: A Coastal Wetlands Permit is needed to excavate, dredge, fill or erect structures on coastal wetlands.
Treatment Works Approval: A TWA permit is required for the construction, modification or operation of a treatment works, including
sanitary/industrial sewage pretreatment or treatment systems, sewage conveyance systems, sewer extensions and subsurface sewage disposal
systems.
Waterfront Development: A permit is required for any project involving the development of waterfront near or upon any tidal or navigable
waterway in the State.
General Information
The DEP Bulletin is an information service provided by the New Jersey Department of Environmental Protection. In compliance with the
Rules and Regulations Governing 90 Day Construction Permits (NJAC 7:1C-1.1 et seq.) this semi-monthly publication contains a list of
construction permit applications recently filed or acted upon by the DEP. Using the Application Milestone Codes located on the inside
front cover, interested persons can determine the status of Coastal Area Facility Review Act (CAFRA) permits, Federal Consistency
Activity permits, Freshwater Wetlands Individual and Statewide General permits, General Groundwater Petroleum Products Cleanup
permits, Open Water Fill permits, Solid Waste Facility permits (SWF), Stream Encroachment (SE) permits, Tidal Wetlands permits,
Waterfront Development permits and Treatment Works Approvals (TWA).
In addition, a calendar of Events of Interest and a Schedule of Public Hearings is provided. The public hearings listed do not, however,
constitute an official notice. Environmental Impact Statements acted upon during the period are also shown. Additional information
concerning the permit applications can be obtained by calling the project manager at the appropriate office listed on the inside back cover.
Public Hearings are held for the purpose of obtaining input and reaction to a proposed rule, regulation, or new program. Some hearings
may be mandated by law. Generally their scope of impact is statewide or of broad general interest and open to the public.
Contested Case Hearings are held between the State and a particular party involving an application, enforcement violation or an appeal.
Interest in these hearings is generally limited to those directly involved.
DEP Events of Public Interest include public hearings, council meetings, workshops, public information meetings, and exams.

GREEN ACRES PROGRAM
NOTICE OF PUBLIC HEARINGS
Take Notice that in accordance with N.J.S.A. 13:1D-51 through –58, the State of New Jersey,
Department of Environmental Protection, Green Acres Program, will hold two public hearings to seek
comments on a proposed sale of property in located in the Town of Hackettstown, Warren County.
The Department of Environmental Protection, Division of Fish and Wildlife wishes to obtain State
House Commission approval to convey up to a 42-acre portion of Block 107, Lot 37 in the Town of
Hackettstown, Warren County to Centenary College. The conveyance was requested by the college in
order to alleviate a dire shortage of athletic facilities for students at the college. If the proposed sale is
concluded, Centenary College will construct on the property three multipurpose athletic fields, including
lighting, bleachers, a gravel parking area and a small building to house equipment storage, offices and
rest room facilities. The property will be conveyed to Centenary College with development restrictions.
The property proposed for sale was acquired by the State in 1914 as part of a larger 167-acre parcel
acquired with proceeds of the Hunters and Anglers License Fund. It is currently administered by the
Department of Environmental Protection, Division of Fish and Wildlife as part of the Charles O.
Hayford State Fish Hatchery. Of the 42 acres that may be conveyed, 25 are currently farmed and the
remainder are wooded. If more than 25 acres are sold, the wooded portions of the property will be
restricted as buffer areas to the athletic fields. The Department of Environmental Protection has no
current plans to expand hatchery operations onto this property.
The compensation for the proposed sale is currently under negotiation. However, Centenary College
will pay the State at least the fair market value of the property as determined by two appraisals to be
commissioned by the State.

NOTICE OF SETTLEMENT
The Department of Environmental Protection has executed a settlement in the matter of Reminger v.
City of Sea Isle City v. State Department of Environmental Protection, Superior Court Docket Number
CPM-L-739-96 for the property designated as Block 89.01, Lots 11.01, 11.02, 12.01, 12.02, 13.01,
13.02 of the official tax map of the City of Sea Isle, Cape May County, New Jersey.
The settlement dismisses the third-party claims against DEP. The settlement authorizes the owner of the
above-referenced property to apply for a Coastal Area Facilities Review Act permit for a single family
dwelling, associated sidewalk, driveway and conservation easement restricting future use of the areas of
the property marked "Conservation Easement Area." The applicant submitted a plan entitled "Block
89.0-1 Lots 11.01, 11.02, 12.01, 12.02, 13.01, 13.02, City of Sea Isle, Cape May County, New Jersey,"
last revised April 7, 2003, and prepared by Engineering Associates, P.A. In the event that DEP denies
the permit, the City of Sea Isle is to address liability as per the settlement agreement.
To date, the owner has applied for a CAFRA permit, but DEP has reached no decision yet regarding the
application or the plan.

Notice is hereby given that the New Jersey Department of Environmental Protection (Department), Site
Remediation Program, proposes to issue the following New Jersey Pollutant Discharge Elimination
System permit actions in accordance with N.J.S.A. 58:10A-1 et seq. and N.J.A.C. 7:14A-1 et seq.
The permit action prepared by the Department is based on the administrative record which is on file at the
offices of the Department, Site Remediation Program, located at 401 East State Street in the City of
Trenton, Mercer County, New Jersey. It is available for inspection, by appointment, Monday through
Friday, between 8:30 A.M. and 4:00 P.M. Appointment for inspection may be requested in writing to the

attention of the file custodians. Appointments for inspection of the NJPDES file only or requests for a

Comments on the draft document or a request that the Department holds a non-adversarial public hearing
must be submitted in writing to the person specified below and shall be postmarked within 30 days of the
date of this public notice. All persons, including the applicant, who believe that any condition set forth in
this document is inappropriate, must raise all reasonable issues and submit all arguments and factual
materials supporting their position by the close of the public comment period. Any request for a hearing
shall state the nature of the issues to be raised. A public hearing will be conducted whenever the
Department determines that there is a significant degree of public interest in the permit decision. If a

Executive Summary

The existing facility consists of a 458,500 square foot (sq.ft.) building with
400,000 sq, ft, for warehouse and 58,500 sq. ft. for office, and employs 80
persons. Four additional warehouse/office buildings are proposed with the
following specifications: Building 1 will consist of 150,000 sq. ft. of warehouse
and 15,000 sq. ft. of office space and will employ 85 persons. Building 2 will
consist of 40,000 sq. ft. of warehouse and 10,000 sq. ft. of office space and will
employ 50 persons. Building 3 will consist of 80,000 sq. ft. of warehouse and
20,000 sq. ft. of office space and will employ 58 persons. Building 4 will consist
of 64,000 sq. ft. of warehouse and 16,000 sq. ft. of office space and will employ
47 persons. The design flow did not include restaurants or food services,
therefore, no restaurants or food services are permitted at the facility. The
proposed facility has a sanitary wastewater design flow of 19,900 GPD. The
wastewater will be directed to an on-site wastewater treatment and disposal
system. Wastewater disposal is facilitated through two subsurface disposal beds
with a total area of 9,600 sq. ft. The effluent discharged to the disposal beds
will meet the Ground Water Quality Standards (GWQS) for all parameters of
concern.
The facility intends to use treated effluent for fire protection and landscape
purposes and will follow the guidelines and limitations outlined in the
Reclaimed Water for Beneficial Reuse (RWBR) Technical Manual.
Approximately 500,000 gallons of on-line storage is proposed for fire protection
(Industrial systems, maintenance operations and construction) and landscape
irrigation. The wastewater will meet the fire protection and spray irrigation
(public access) quality limits required by the NJDEP’s Effluent Reuse Treatment
Guidelines within the RWBR manual.
