An act is "oppressively" done if done in a way or manner which injures, damages, or otherwise violates the rights of another person with unnecessary harshness or severity, as by misuse or abuse of authority or power, or by taking advantage of some weakness, or disability or misfortune of another person. The amount of damages may not be based on speculation or conjecture. Unless you find that the requesting party has proven, with a reasonable degree of certainty, the amount of actual loss incurred as a proximate result of the other party's actions, you may not render an award of compensatory damages for the requesting party.
