escort corporation and you have contractors they're going to need their 1099s prior to the end of january i need you to know if you need to send out a 1099 what happens if someone wants to not sign the w-9 and what you need to do to protect yourself if you have international employees working with you let's dive in all right guys first things first what is a 1099 contractor we just need to define that so i'm going to give you the exact definition so you never get this confused again an independent contractor is a person business or corporation that provides goods or services under a written contract or a verbal agreement it's you and another party deciding that this party is going to do a contractual work for you to get to a result most of 99 contractors are not like employees they can stipulate their own time when they do their job in the nature in which they do their job and if you're a 1099 employee then you need to know that there are certain forms that need to be signed by you prior to you filing the tax return and if you're issuing 1099s then you need to make sure you're issuing them the right way so we're going to talk about that when it comes to who receives a 1099 a 1099 is provided to any contractor that is making an excess of 600 from a business owner so if i contracted my videographer to record a couple of videos for me in the year and i'm paying over over six hundred dollars it is my duty and obligation underneath irs tax code that if he is making over 600 that i have to issue him a 1099. but many taxpayers get caught up in not issuing 1099s and here's the reason why this happens one many taxpayers are late when they find out that they actually need to send out a 1099 and then maybe the contractor that they have working as a 1099 contractor does not have social security numbers papers or green cards they're a little worried about reporting that 1099 contractors so we're going to talk about that two you just completely forget to do your 1099s because maybe you're just a taxpayer that's just running around and building business income you just never knew that you were supposed to send out to 99s so we're going to talk about that or number three maybe you're a taxpayer that has already sent out your 1099s and you don't know how to make sure that they're being filed correctly so these are three situations that we can fall tax provider that lets me know what i need to do like i just want to be able to run the business and like the tax guy does everything but here's the thing though a lot of tax professionals are not there with you business owner when you're hiring these contractors you're talking to these contractors on various different networks like nomina if you're talking to contractors on networks and you decide to go into an agreement there's one thing that you need to make sure you do prior to you paying this contractor and i'm going to give that to you you need to have the contractor signed a w9 form here's the w9 form it's this one right here this form is the form you want to have your contractor sign and provide back to you why because when it's time for you to file to give a 1099 which is kind of like a w-2 for that employee that contractor you have to file something to provide the 1099 and this something that you're filing is the w9 form the w9 form is the form that you as a business owner should receive back prior to receiving any payment or giving any payment to any business owner to protect you the business owner underneath an irs audit i have had so many clients who have told me carlton why is it that these contractors don't give me this w-9 form back i'm stressed i know you told me i have to file my 1099s by a certain date and i'm telling them like hey man listen if you had came to me in the beginning before you decided to send out payments to these contractors you would have been told by me to not do it because i would have told you to get that w-9 form back first i'm totally cool with contractors i'm totally cool with business owners wanting to hire contractors that might be on the border of having their their full cards and full citizenship but if you are the taxpayer that does not want to get in trouble with the irs then you'll make sure you get the w9 form back it's that simple and the w9 form does require you obtaining the social security number or the ein number of the taxpayer that you are looking to pay if you're hiring contractors who are on the border of this whole citizenship thing i am letting you know right now carlton is telling you right now please be careful because at the end of the day your contractors aren't going to be the ones that are in trouble you the business owner are going to be the one that's in trouble for not providing a 1099 to your contractor in filing the 1099 by the due dates that the irs is listed will it be your contractor's fault at the end of the day you will be at fault and i want to make sure that business owners are protected because the government states you're supposed to receive the w-9 before before you even started going into a contractual agreement you should have already had the w-9 signed by the contractor that you want being contracted to do the work inside of your business so this very key important step is one step that i will constantly see business owners make a mistake out of and make a mistake out of but you the business owner that just watch this will never make that mistake again now the next thing that we need to do after we've obtained this w9 form is we can start paying out this contractor and now we're in a place where we are doing the right things but what is another step that we have to take to make sure that we have done everything that we should have done to properly issue the 1099 out to the contractor we actually have to file the 1099 so let's talk about that all right guys filing form 1099 has to be done by january 31st of every single year that means if you're watching this video you have a little bit of time to get your 1099s filed without paying penalties and late fees in order to file the 1099 you'll file form 1099 with form 1096 and you'll submit this information to the irs this is something that you can do as a taxpayer through any type of portal system or working with a tax professional like my team filing your form 1099s by january 31st will ensure that you have told the irs who you hired how much you paid them so the irs has documentation that this person was a citizen that was contracted to work underneath this company's ein number all transparency needs to be above table with the irs as it pertains to 1099s but failure to 1099 can start a trickle effect that you do not want to see what is that trickle effect carlton well i've seen taxpayers who forgot to 1099 then they got audited for not 10.99 then they had to pay late fees and penalty fees for not 10.99 and then the auditor took the time to even see if all these contractors were meant to be contractors and then they find out that some of your contractors are actually supposed to be w-2 employees and now you're having an issue with the edd the payroll department because you didn't pay payroll taxes and workers compensation for all these employees that you had as contractors because you didn't understand what a contractor was you didn't provide the 1099 in time you got audited and you had some employees listed wrong a trickle effect and i guarantee you if you're hearing this right now it sounds a bit scary this video is not meant to scare you it's meant to give you information so you can avoid getting into trouble and if you're trying to avoid getting into trouble as a taxpayer you'll take this information seriously you'll get the w9 signed you'll file your 1099 by january 31st you're not going to work with taxpayers who don't will who aren't willing to accept a 1099. but what about if we have international taxpayers carlton what about if we have international contractors carlton how does that work let's talk about international all right guys if you guys have an international contractor technically there is no 1099 you have to provide oh hold on a second there but what how does the irs know how do they get to know what i'm doing with the international people there's still something that has to be filed let's talk about it taxpayer so if you have a non-resident alien an nra a taxpayer that does not live in united states there is still information that you have to file with the irs why because irs cares about information they're like google they just want to have access to all of the information so they know what's going on and where eventually they can collect tax dollars from the form that the irs would like you to fill out is called form w8 ben b-e-n it's right here form w-a bin is a form that will give the irs information on the non-resident alien that you've contracted to work inside of your company so if you're a taxpayer that's gotten on a app or a program to look up how you can hire a contractor and you find out that this contractor is international does that mean that you have to provide a 1099 no but does that mean that you still need to do documentation to show the irs that you had an international employee contracted to work inside your business yes and the form that carlton just shared with you is called form wa ben we're learning right now how to never get ourselves in trouble as it comes to 1099 contractors but the one thing that i want to make sure that i finish this video sharing with you guys is that you understand the difference between a contractor and an employee here in california it's a lot harder because we have this ab5 law that was signed in by gavin newsom which extended definitions of what a contractor was and what an employee was but if you're someone that's watching this video and you're trying to decide am i hiring this person to be a contractor if i'm hiring this person to be employee i want you to take a sit back for a second are you going to be determining the hours in which that person works every single day telling them exactly how to do their jobs taking some of the control away from them being able to work for another employer are you dictating how they do they work do their work how they show up to do their work where they do their work from and are you even giving them tools and equipment to do their work because if you said yes to any of those items that i just listed then that person is an employee with an e and you need to make sure that you're providing a w-2 to that person now if that person does not check any of those boxes most likely that person is a contractor which means they can work for somebody else dictate their own job flow and how they earn their money that means that the income that they receive from you is not going to have taxes withheld and they're not going to have payroll taxes already paid benefit to being a business owners you receive income first have your expenses second and then you pay uncle sam third the difference with an employer is you pay taxes first then you get paid and then you earn a refund later on whatever you were overpaying in taxes so there's a beauty to being a contractor now i just wanted to stop and say that i am so happy that you guys
