you may remember this video uploaded in 2019 in which doip police officer Robbie jeffcott threatened to ticket this driver for daring to talk back he then assaulted and arrested him for not doing as he was told don't open the door I'm going to smack it what for cuz it comes back to a black MK and I want to make sure your docks are all in order it's not a Mercedes pardon it's not a Merc jagu it comes back to now it is it is black look at the roof the law states smash the window there's no need mate you need to speak you need to speak to your office the law states that this is you have to if you change over three quart one quarter of your cut what are you doing mate if you don't open the window and shut the car off now and do as you're told the car is shut off why you got B now count why have you got you're being video and audio recorded all right fair enough there's no need for the Baton there is cuz you're not doing as you're told you're going to be yourself lifted to check your know that you'll get the ticket to something do as you're told right there's no need to be so aggressive no I'm being aggressive because you're not doing as you're told and I don't know whether you're going to try and floor it out of here and run me down Etc ET I ain't getting out of there you're you're turning a simple traffic stop into a big issue you're going to get yourself arrested in a second for obstructing police and for driving matters do you understand if you don't do as you're told now I'm asking you open the door and get out so I can confirm who you are or show me some I can confirm who I am from here as per with the way you've as per the Road Traffic Law you're meant to produce your driving license and insurance to me why have you got an attitude towards us and saying you can't do this you can't do that well you're you're coming at me with a baton first of all you don't need to be so aggressive why do I need to open the door you can confirm Who I Am from outside the car situation safe and the car Switched Off the car is being switched off as soon as you got here mate as soon as I pulled up I turned the car I didn't know that did I I'm Sergeant from the no excuse team you can see the blue lights you've been order to stop you're not abiding by the Road Traffic Law I've stopped and I've put my keys up here as you can see my car is stopped right open the door cuz I want to have a look at the tint on the windows open the door I want to have a look at the tint of the windows well thank you see it's not too difficult is it it's not too difficult was it no you can put the phone down as well no definitely not definitely not not not with the way you've been uh pulling B out pull you be arrested I told you I don't have a driving license on me I need you to come assist my car I'm not going to do that I'm afraid I need to bot out whether you're drunk or not or you've had a beer I can't do that out here I'm under arrest sorry what time splishing the drive and no insurance no license get a camera on me here take that if you if you AR there's no need to Hur me the original upload created such an outrage that Dorset police found elves inundated with negative comments on their Facebook page and a grilling in the press this prompted dset police to issue a press statement in which they claimed Jeff cot was subject to management action police chief vacular for a slap on the wrist however the statement was untrue as Jeff cot suffered no sanctions whatsoever and continued unimpeded in his position as little man with big chip on his shoulder the then police and crime commissioner for doit police Martin Underhill was interviewed on BBC Radio and asked for his comments on the incident so um I have watched the footage and I I have to say wouldn't I and there's always two sides to story uh and I noticed that the officer's body video was uh being used uh and I know the police are examining that as we speak um I mean I share your concern frankly having watched the video um especially as I used to renovate repair cars and spray them so uh I I can see how this argument happen but some of the uh issu isues in that video do concern me but I must stress my role is not to intervene and hold the police to account until their processes are finished that complaint is still live and being investigated so I'll keep it watching brief until then but I am more than happy to meet that member of the public um I don't know his name actually to be fair um but I I'm happy if he's listening to meet him in a PCC surgery but I cannot get involved until the complaints been uh investigated by the police the driver kle Carpenter sued dorsit police for assault battery and falce imprisonment to which they put up no contest they were forced to pay out substantial damages but still they refused to discipline Jeff cot and just a few months later he was at it again have you got your driving license on you please yes I have actually so what why' you want to see it I've cautioned you because I'm going to isue you a ticket for missuse of horn you're not mate I am sir you you are not I'm sorry if you do not if you do not allow me to deal with this at the roadside I'm going to have to arrest you take you to the police station me then I've done absolutely nothing wrong what did you use your horn for so because you pulled out in front of me if You' have had your lights on if you'd have had your lights on I'm not arguing with you well I'm arguing with you I'm sorry this lady here never mind who it is as it was clear that Jeff cot was rapidly coming off the hinges with the police doing nothing about it the only solution was to bring a private prosecution against him for assault and false imprisonment at the time however I had had my hands full with a prosecution against two other errant cops PC cotton and buckle so I was extremely grateful when I was contacted by a lawyer who wanted to bring the prosecution himself my name is Ben Whitehead I'm a lawyer and I pursued a private prosecution against Robbie Jeff at the time I warned Ben that the Judiciary were adopting an unofficial policy of refusing to issue summons against any police officer who is subject to a private prosecution so I suggested to him that when the magistrates Court refused to issue summons as they were likely to do I would help him take the matter to the high court What charges did you bring against the so in the application for summons I alleged uh four offenses so the first one was false imprisonment in relation to the way that Jeff cot had arrested Carl I also alleged a common assault in relation to his use of the Baton quite so early into the interaction um and then I alleged two public order offenses in relation to the state M he was making his aggression and his tone throughout the incident the first step in any private prosecution is to issue what's known as an information this is in effect an application for summons so the offender can be brought to court to answer criminal charges in the first instance the court is likely to ask the prosecutor and the proposed defendant to attend the court where it's the judge's job to ensure that Prima Facey evidence exists that the offense was committed and that the prosecution is not an abuse of process how long from the moment that you issued the application for summons until you actually got a hearing how long was it the actual hearing where the issues were actually discussed um I think that took around two years so the first one was remotely um in pool magistrates Court that's right that was extremely brief uh the judge hadn't seen the copies of the footage and I had to resend them burn them onto a DVD and send them over to the court so you hadn't met judge itam at this point no so at this point the original jge hadn't yet retired he then retired and judge rram took over how is it that a dock cop who commits a criminal offense the application somehow ends up at Westminster magistrates Court uh because the original judge had retired and they hadn't found a replacement yet um the deputy senior magistrate that oversees them was brought in to to take over that did they make you go all the way to Westminster just for a hearing so I was told that that hearing had to be in person um I was told that that was due to the nature of the matters to be discussed uh however when I turned up uh judge rram was actually appearing via a video link directly from Westminster so the judge appeared on a screen uh we were all looking up the microphones didn't work correctly I had to be reated uh there were quite a few techn technical issues um but but yes he appeared remotely essentially we had to continue to chase over the space of I would say around a year to actually get a uh a decision decision and what was it K's decision the decision was effectively uh that there was not evidence that Jeff cot had um committed any offenses my name is tan ikram I'm the deputy senior district judge of England and Wales as the deputy senior District Judge I sit on uh various types of cases in particular extradition hearings I also deal with the more sensitive and difficult cases across the country and I also provide leadership to 300 other judges in my jurisdiction not only did Judge itam refus to accept that Jeff C had exceeded his powers and was behaving in a criminal manner he refused to watch the actual video footage itself he excused Jeff cot by stating he was just trying to keep the situation safe of course he was by shouting at it threatening it brutalizing it trying to stitch it up and then maliciously arresting it the core values of the profession well I suppose the most most important thing is I mean our ethical standards and we're very jealous and proud of doing the right thing tanir ikram and he presided over the case of the three women who joined a pro Palestinian March uh very shortly after the October the 7th atrocity there he is uh and they were found guilty of supporting a prescribed terrorist group Hamas because on the back of their jackets they had paragliders or pictures of paragliders of course Hamas used paragliders to cross the Israeli border and commit uh their October the 7th uh genocide uh so they found guilty of this fence offense the judge basically said well he didn't basically said he did say this he said well you've learned your lesson there won't be any punishment but don't you do that again uh now uh subsequently he is a Muslim but uh that shouldn't necessarily be a factor in our discussion but he has been found to have liked social media posts one saying that Israel is a terrorist country uh so he has a history of this and so the accusation is he let his own prejudices uh uh affect what he did with these three women the comment that rram liked had been posted by sham Udin a qualified Barrister and like most barrers an aor attention seeking [ __ ] who clearly knows no better better judge rram is a senior district judge and should have known better so when he was caught agreeing with Udin pal ofilia he immediately went into our saving mode his defense was as simple as it was brilliant he liked that posting accidentally he even went as far as to employ a forensics team to examine his computer who by some remarkable feat of reverse engineering came to the same conclusion that he had pushed the button by by accident it was abundantly simple they said for a LinkedIn user to inadvertently trigger a like using their iPhone by double tap in an image almost as simple as the same double tap you need to do it deliberately but it didn't matter because ITR had mates in high places and they all agreed he done it accidentally and allowed him to keep his position with nothing more than a telling off by the Lord Chancellor as the lady chief justice stated he has been at the Forefront of work to promote judicial diversity and if you're wondering what that diversity sounds like it's something like this free free Palestine to the Israeli terrorists both for the United Kingdom the United States and of course Israel you can run you can bomb but you cannot hide Justice will be coming for you when I applied to become a full-time Judge first time around they said no and they said I wasn't good enough and so I had to apply again I had to pick myself up the confidence to reapply and I got it second time Round And since then I'm now the deputy senior district judge for the country all right Ben good luck thanks I mean it and I'll see you in there in about if the magistrates Court refuses to issue summons there is no mechanism for appeal instead you have to apply to the higher court for a judicial review a process whereby you can challenge unlawful decisions made by public bodies in this case we were challenging judge Ram's irrational and wholly biased refusal to issue summons against Jeff cot for the assault and falce imprisonment committed against Kyle Carpenter it took 2 years before our application was finally heard in the Royal courts of Justice on the 5th of November 2024 bringing the time we'd spent attempting to prosecute Jeff gotot to 4 years in total 6 days later the Judgment was handed down lord just Edis took the position that itam was entitled to consider that primia assault and false imprisonment had not been proven and that a judge could in effect decide for themselves whether or not an officer has broken the law without having to justify their reasoning no consideration was given whatsoever to the gravity of the abuses committed by Jeff cot instead the blame was heaped entirely upon the driver for not cooperating as if surrendering your civil rots to the unlawful demands of a power CZ police officer somehow absolves them from Criminal liability for assault and false imprisonment the judgment is littered with off-hand remarks errors and irrelevances the most misconceived of these is the suggestion that is not obvious why private prosecutors should be allowed to bring prosecutions where there's no realistic Prospect of conviction and the proceedings are not in the public interest such prosecutions will waste valuable and limited public resources which could otherwise be used trying serious cases where the full Code test is met like these serious cases that the police and the CPS have no problem whisking through the courts on a regular basis had Carl Carpenter dared to resist Jeff cot's whirling dervish of police misconduct or raised a weapon at him in a display of power he would be in prison right now but we shouldn't be surprised that Lord Edis regards assaults against the general public as trivial because he's a fully paid up member of the ruling class living in his gated community in the home counties and of course there's no realistic Prospect of a conviction if judges consistently refuse to acknowledge police law breaking regardless of all this judicial interference the attempted prosecution was ultimately a success because thanks to the Court's endless delays and Jeff cot had been left twisting in the wind for four long years not knowing whether or not he'd prosecuted or sacked as a result he threw in the towel and resigned from doip police so another unhinged violent police officer has been removed from Frontline policing of course the police Federation who represented Jeff cot thought that they would get the opportunity to hammer us with a £12,000 cost bill but alas they were defeated because this was a judicial review surrounding criminal matters no costs could be reclaimed this is because only magistrates courts Crown courts and the court of appeal can make orders for costs in respect of criminal proceedings not the high court however it costs over £1,500 in application fees and expenses to bring this review and over 200 hours of work Ben in particular spent weeks preparing the judicial review and the oral arguments which took a full 90 minutes to recite in the high court he did us proud regardless of this we both agree it was worth the investment because it achieved our aim to have Jeff cot removed from the false you'll get the ticket to something now the dust is settled this judgment confirms what I've known all along the police are held to a very different standard of law than the rest of us but we won't stop we'll go on privately Prosecuting any corrupt police officer that displays signs of violent tendences toward innocent members of the the public that the police and the CPS refuse to touch if you want to help with this and please consider donating
