Agreement between Church and Director of Education Employment agreement made this       day of       , 20       , between       , a nonprofit Church Corporation organized and (Name of Church) existing under the laws of       , with its principal office located at (Name of State)       , referred to herein Church, and (Street Address, City, County, State, Zip Code)       , of       , referred to herein (Name of Employee) (Street Address, City, County, State, Zip Code) Educational Director or Employee. I. Employment; Duties. The Church hereby employs the Employee as its Director of Education and the Employee accepts such employment. The duties include, but are not limited to, the following:  Be responsible for planning activities and special events for the church family, i.e. children, youth and adults and will be present to implement them.  Be involved in curriculum selection, planning and materials and supplies procurement with the Board of Elders.  Coordinate the youth activities of the church.  Be a resource for teachers, advisors and the youth in planning and implementing programs.  Have responsibility for training teachers and other leaders in the churches educational programs.  Work with other church boards and committees when appropriate to the Christian Education Program.  Serve as Sunday School Superintendent.  Attend when possible area and regional programs and conferences which deal with topics within the scope of Christian Education and Youth Ministries.  Confer with administrative personnel to decide scope of program to be offered.  Prepare schedules of classes & rough drafts of course content for defining number background of instructors needed.  Interview, hires, trains, and also evaluates work performance of education department staff.  Assist instructors in preparation of course descriptions informational materials for publicity or distribution to class members.  Prepare budget for education programs as well as directs maintenance of records of expenditures, and receipts and  Such other reasonable matters related to the purposes of the Church as the officers and Elders of the Church delegate to the Employee as or may be provided for in the Bylaws of the Church. II. Compensation. The Church shall pay the Educational Director a salary of $       per month. The Church must withhold FICA and federal income tax in accordance with law. III. Expenses. The Church shall reimburse the Educational Director for all reasonable and necessary expenses which he may incur relative to his services for the Church, including but not Agreement between Church and Director of Education Page 1 of 4 limited to travel, telephone, postage, typing, and copying expenses. The Church will provide reimbursement within       days of submission by the Employee to the treasurer or any (Number) other officer of the Church of documentation supporting expenditures. The term of this Agreement will commence, and the Employee's salary will commence, on       , and will continue until terminated, with or without cause, by either party on written notice to the other. V. Hours of Employment. The Education Director is expected to work at least       (Number) hours per day and       hours per week, Monday to Friday. The Church will notify the Education Director (Number) as much in advance as practical with respect to the holiday schedule. The holidays which are generally observed by the Church are as follows: New Year's Day, Washington's Birthday, Good Friday, Memorial Day, Independence Day, Labor Day, Columbus Day, Thanksgiving Day, the Friday following Thanksgiving, and Christmas Day. Additional holidays may be allowed in connection with holidays which fall on weekends. 2. The personal days are to be scheduled in advance to the mutual convenience of the Education Director and the Church. Such personal days must be taken during the calendar year and cannot be carried forward into the next year. 3. The Education Director will not be entitled to any personal days unless the Education Director has been employed for a period of (minimum employment period) during the calendar year. If the Education Director has been employed for less than the required time, the Church may, in its own discretion, allow the Education Director a reduced number of personal days. B. Vacations. Agreement between Church and Director of Education Page 2 of 4 1. The Education Director will be entitled to vacations after the first       (Number) of months of employment with the Church. The Education Director is allowed       sick days per year. Sick (Number) days are not cumulative and may not be carried from year to year. D. Emergency Leave. If a member of the Education Director's immediate family dies or becomes critically ill, the Education Director will be allowed up to       days (Number) of leave with pay. Additional time may be granted, without pay, upon approval of the Church. VII. Hospitalization Insurance. The Church shall pay for hospitalization insurance for the Education Director with such insurance company and such coverages as the Church from time to time chooses. The Education Director shall have the right to add his spouse and minor children to the policy coverage by paying the additional premium for them and satisfying any other conditions of the insurance company. VIII. Termination of Employment. Either party may terminate this Agreement and the employment under this Agreement without cause and at any time upon       days' written (Number) notice by certified or registered mail to the other party at the address set forth above. This Agreement will be automatically terminated upon the death of the Education Director. IX. Severability. The invalidity of any portion of this Agreement will not and shall not be deemed to affect the validity of any other provision. If any provision of this Agreement is held to be invalid, the parties agree that the remaining provisions shall be deemed to be in full force and effect as if they had been executed by both parties subsequent to the expungement of the invalid provision. The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred. XI. Governing Law. This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of       . (Name of State) XII. Notices. Unless provided herein to the contrary, any notice provided for or concerning this Agreement shall be in writing and shall be deemed sufficiently given when sent by certified or registered mail if sent to the respective address of each party as set forth at the beginning of this Agreement. In the event that any lawsuit is filed in relation to this Agreement, the unsuccessful party in the action shall pay to the successful party, in addition to all the sums that either party may be called on to pay, a reasonable sum for the successful party's attorney fees. XIV. Mandatory Arbitration. Notwithstanding the foregoing, and anything herein to the contrary, any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. XV. Entire Agreement. This Agreement shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding upon either party except to the extent incorporated in this Agreement. XVI. Modification of Agreement. Any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by each party or an authorized representative of each party. XVII. Assignment of Rights. The rights of each party under this Agreement are personal to that party and may not be assigned or transferred to any other person, firm, corporation, or other entity without the prior, express, and written consent of the other party.
