AGREEMENT AND RELEASE FORM This Agreement is made and entered into this the ____day of ___________, 20____ by and between ___________________________(hereinafter “Interviewee”) and _______________________________ (hereinafter “Author”) for mutually agreed consideration and is subject to the following terms and conditions: 1. Interviewee as Information Source . Interviewee agrees that no contract of employment is created by this Agreement and that information provided by Interviewee to Author is true and correct to the best of Interviewee’s knowledge and recollection. 2. Publicity and Use of Likeness . Interviewee agrees that Author may use the information obtained from Interviewee for purposes of present and future publicity, commercial exploitation, advertising and promotion of any and all products and services associated with the written work of Author. 3. Compensation. No monetary compensation shall be due or payable to Interviewee from Author or Author’s successors, estate, assigns, agents or publishers for information provided to Author by Interviewee. Interviewee expressly and unconditionally waives any demand for further compensation and releases Author from liability and expense of any kind whatsoever for the current or future use of information obtained from Interviewee. 4. Author’s Duty. If Author in his sole discretion elects to use any or all of the information provided to him by Interviewee, Author shall use all reasonable eforts to present the information so provided without distortion and shall not knowingly use such information in a malicious or untruthful manner. It is understood and agreed by all parties hereto that Author has substantial discretion in using the information so provided by Interviewee in works of fction and non-fction and, further, that Author’s artistic use of such information shall not be unduly constrained by this Agreement. 5. Non-Exclusivity. Interviewee and Author agree that this Agreement does not restrict the right of either party to enter into similar arrangements with individuals or parties outside of this Agreement, so long as any obligations incurred thereunder do not confict with this Agreement. 6. Independent Advice. Interviewee represents and warrants that he/she has been advised of the right to seek legal counsel of his/her own choosing in connection with the approval and signing of this Agreement. 7. Entirety. This instrument supersedes any prior negotiations, discussions or agreements and sets forth the entire agreement between the parties with respect to this subject matter. No modifcation shall be binding unless confrmed by a written instrument signed by both parties. 8. Applicable Law. The parties hereto agree that this Agreement is to be enforced and construed according to the laws of the State of ______________ and, in the event that any portion of this Agreement is set aside by a court of competent jurisdiction, the balance shall remain in full force and efect to the extent feasible.
