Agreement to Attempt to Locate Unclaimed Property of Client Agreement made on the _______________ (date) , between _______________ _______________ (Name of Company) , a limited liability company organized and existing under the laws of the state of _____________, with its principal office located at _____________________________________________________________________ (street address, city, state, zip code) , referred to herein as Company , and ___________________ (Name of Client) of __________________________________ __________________________ (street address, city, state, zip code) , hereinafter referred to as Client. Whereas, Company is in the business of bringing unclaimed property to the attention of the owners of the property; and Whereas, Company has good and sufficient evidence that it has located some unclaimed property of Client; Now, therefore, for and in consideration of the mutual covenants contained in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Company shall serve as Client’s exclusive agent in claiming this property, and Client hereby appoints Company as his/her attorney-in-fact to process Client’s claim. Company will advance all costs and perform all reasonable duties necessary to process the claim. 2. Company agrees to provide all forms and documents required to process Client’s claim. Client agrees to sign and return all documents within three (3) days of receipt. 3. Upon receipt of said forms and documents, Company shall provide Client with a written disclosure regarding the nature and history of the property. 4. Client and Company agree to cooperate fully with one another in processing this claim and with reasonable requests made by the other party. 5. As compensation for Company’s services, Client shall pay to Company ____ % of the net value Company recovers for Client. 6. Client shall also reimburse Company for all reasonable costs, necessary disbursements, and reasonable personal and travel expenses incurred by Company in processing Client’s claim. Said reimbursement shall be made from the gross proceeds of any recovery, which reimbursement shall be in addition to the above-provided percentage fee . 7. Client gives Company a power of attorney to execute all documents connected with the claim for the purposes of recovery. 8. This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of _____________.
