whether the Museum is to clean or repair the Object, and the charge) .
Owner has lent the Object to the Museum and the Museum has accepted the
Object on loan subject to the following terms and conditions:
I. Purpose of Loan
The loan has been made in order to enable the Museum to exhibit the Object at a
special exhibition of (description of exhibition) to be held at the premises of the Museum
from ___________( date) to ____________ ( date) . The acceptance of the Object on loan
shall not obligate the Museum to exhibit the Object if it elects not to do so.
II. Use and Return of Object
A. If the Museum elects not to exhibit the Object, it shall notify the Owner to
that effect within ___ weeks after the opening of the exhibition; and the Owner shall
withdraw the Object at his expense from the Museum within ____ weeks after receipt of
the notice.
B. If the Object is exhibited, it shall be available for withdrawal by the
Owner ____ week(s) after the close of the exhibition. If he so requests, the Museum shall
return the Object to him at its expense.
C. If the Object is offered to the Museum for sale or as a gift, and if it is
declined, it shall be available for removal by the Owner immediately on the sending of
the notice of declination if the Object is not exhibited, or _____ weeks after the close of
the exhibition if it is exhibited.
D. If the Object is not exhibited and is not removed from the premises of the
Museum within ____ days after the Museum notifies the Owner that it is available for
withdrawal, the Museum shall have the right and option to return it to the Owner, collect,
or to sell it. In the case of a sale, the Museum shall be under no liability or obligation
whatever to the Owner except for the proceeds of the sale, if any, without interest, and
less any out-of-pocket expenses incurred by the Museum.
E. The description given above under the item entitled "Description of
Object" has been supplied by the Owner. It has not been verified by the Museum, and
shall not be taken as an expression of opinion by it.
F. The Museum shall not be responsible for the preservation and safekeeping
of the Object beyond the taking of such precautions as it ordinarily exercises in the
preservation and safekeeping of its own property. It shall insure the Object only if the
Owner expressly so requests. In that case insurance shall be effected under the Museum's
blanket policy at the Owner's valuation above stated; and the insurance shall cover only
those risks against which the Museum insures its own property under the policy. In the
event of loss or damage, the Owner's recovery, if any, shall be limited to such amount as
may be paid by the insurer; and the Museum, its officers, agents, and employees shall not
be liable for any claims arising out of such loss or damage.
G. Unless the permission to do so has been specifically denied in writing
under the item "Restrictions" above, the Museum shall have the right to examine the
Object by radiographic or other photographic means, and to photograph or otherwise
reproduce it in any medium for purposes of record, education, publicity, or sale by the
Museum under the same rules and regulations as those now or later pertaining to objects
in the Museum's own collections.
H. If the Object is offered for sale, and the Museum accepts the offer, the
Owner shall furnish the Museum with a bill of sale and an affidavit of title in such form
as the Museum may require prior to the payment of any part of the purchase price. If the
Owner fails to furnish the same, the Museum may at its option cancel its acceptance of
the offer.
I. If the Object is offered for sale or as a gift and is covered by statutory
copyright, the Owner shall furnish the Museum with an assignment of the copyright in
such form as the Museum may require, in the case of a sale, prior to the payment by the
Museum of any part of the purchase price, and in the case of a gift, prior to delivery. If
the Owner fails to furnish the assignment of copyright, the Museum may at its option
cancel its acceptance of the offer.
J. The Museum maintains facilities for the cleaning, restoration, and repair
of its own works of art. Private work may be accepted only by special permission of the
Director. Charges for services rendered shall be fixed in advance, and shall be paid to the
Museum. The Museum, its agents, officers, and employees shall not be liable for any loss
of value or damage due to or resulting from any cleaning, restoration, or repair.
