Petitioners are ________________. and ________________, husband and wife; ________________ and ________________, husband and wife; and ________________, a widow, who is represented by ________________ acting under a durable power of attorney for ________________. 2. Petitioners are the owners of real property in the City of ________________, Alabama which is part of the ________________ Subdivision. 3. The property of petitioners abuts a dedicated road, ___ feet wide, which i s part of the original subdivision but which was never opened as a public street. Said unopened road is approximately ____ feet in length from _______________ Street to ____________ Drive. It has been used as a driveway for the residences of ________________ and ________________. It is open only from ________________ Street as a driveway. There is no opening from ________________Drive. Page 2. 4. Other than use by the City of ________________ personnel to check on water and sewer lines there is no need for the uno pened road to continue as a dedicated road and the vacation of said road would cause no injury or harm to anyone nor diminish the value of property of anyone. WHEREFORE, pursuant to the provisions of §23 -4-20 of the Code of Alabama of 1975 petitioners move this body adopt a resolution vacating the unopened public road running from ________________ Street to ________________ Drive with the reservation of the right of the City of _____________, Alabama to go onto said property for the purpose of repairing water and sewer lines.
