AMERICAN COLLEGIATE HOCKEY ASSOCIATION GAME CONTRACT Agreement made on the ___________________________ (date) , between __________ ____________________________________ (Name of College) , a nonprofit corporation organized and existing under the laws of the state of ___________________________, with its principal campus located at ______________________________________________________ _____________________________________ (street address, city, county, state, zip code) , referred to herein as the Home Team , and ____________________________________ (Name of College) , a nonprofit corporation organized and existing under the laws of the state of _______________________________, with its principal campus located at ________________ ____________________________________________________________________________ (street address, city, county, state, zip code) , referred to herein as Visiting Team . The undersigned Home Team and Visiting Team hereby agree to play an American Collegiate Hockey Association (hereinafter referred to as the “ACHA”) sanctioned intercollegiate ice hockey game(s), subject to the following terms and conditions: Game Date(s): Game Time(s): Game Locations _____________________ __________________ _______________________ (Day, Month, Year) (Time, e.g., CDT) (Location of Rink) _____________________ __________________ _______________________ (Day, Month, Year) (Time, e.g., CDT) (Location of Rink) _____________________ __________________ _______________________ (Day, Month, Year) (Time, e.g., CDT) (Location of Rink) 1. The game(s) will be played in accordance with the rules for intercollegiate ice hockey as set forth by the National Collegiate Athletic Association (the NCAA ), unless superseded by the ACHA Policies and Procedures. 2. The Home Team will provide the appropriate number of certified referees for each game and will be solely responsible for all referee costs, including all transportation, lodging and meal expenses, if any. 3. The Visiting Team will be responsible for all of its travel, lodging and meal expenses. 4. The Home Team will retain all gate receipts and the receipts for all merchandise sold by the Home Team. 5. The Visiting Team will retain the receipts for all merchandise sold by the Visiting Team. 6. Both the Home and Visiting Teams warrant that all players participating in the game(s) are registered with USA Hockey and are eligible to compete under the rules of the ACHA, the NCAA, their respective conferences, if any, and their respective college or university. 7. Both teams agree to submit to their opponent an updated roster, including but not limited to, the first and last name of each player, their jersey number, their position (forward, defenseman, goaltender), designation of the team captain(s) and any alternate captain(s), and the names of all members of the coaching staff. 8. Unless otherwise agreed to in advance, the Home Team will wear white or light colored jerseys and the Visiting Team will wear dark colored jerseys. 9. With the exception of inclement weather or other such Act of God, no game may be cancelled unless 30 days written notice is given to the opposing team. 10. In the event of inclement weather or other such Act of God, both teams may cancel this contract without penalty if agreed to at least 3 hours before game time. 11. Failure to attend or hold a scheduled game without contacting the opposing team shall result in the offending team being held responsible for all reasonable, non-refundable expenses incurred by the aggrieved team, including but not limited to all ice reservation and referee costs, travel and lodging expenses. 12. Additional Provisions: _______________________________________________ 13. No Waiver The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred. 14. Governing Law This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of __________________. 15. Notices Any notice provided for or concerning this Agreement shall be in writing and shall be deemed sufficiently given when sent by certified or registered mail if sent to the respective address of each party as set forth at the beginning of this Agreement. 16 . Mandatory Arbitration Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. 17. Entire Agreement This Agreement shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding upon either party except to the extent incorporated in this Agreement. 18. Modification of Agreement Any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by each party or an authorized representative of each party. 19. Assignment of Rights The rights of each party under this Agreement are personal to that party and may not be assigned or transferred to any other person, firm, corporation, or other entity without the prior, express, and written consent of the other party. 20. Counterparts This Agreement may be executed in any number of counterparts, each of which shall be deemed to be an original, but all of which together shall constitute but one and the same instrument.
