BEFORE THE MISSISSIPPI WORKERS' COMPENSATION COMMISSION       CLAIMANT V. NO.             EMPLOYER AND       CARRIER ANSWER TO NOTICE OF CONTROVERSION COMES NOW the Claimant,       , by and through his attorney of record, and in answer to the Notice of Controversion fled herein by the Employer and Carrier, says: I. The allegations of Paragraph 1 of the Notice are admitted. II. The allegations of Paragraph 2 of the Notice are admitted. III. The Claimant admits that he has seen Dr.       and that Dr.       has recommended back surgery for a herniated disc; the remaining allegations of Paragraph 3 of the Notice are denied. IV. The allegations of Paragraph 4 of the Notice are denied. V. It is admitted that there is a Form B - 3 fled with the medical report from Dr.       which the Claimant has received from the employer and carrier is illegible and is not a complete report; that other tests have been done since that report and the Claimant believes that said reports show he has a herniated disc. WHEREFORE, the Claimant asks the Commission to dismiss the Notice of Controversion and allow him to continue to see Dr.       as his treating physician or, in the alternative, that if a orthopedic surgeon or neurosurgeon is designated by the Commission for determination of whether surgery is necessary, that the Commission appoint either Dr.       or Dr.       .
