- 1 - AUCTION SERVICES AGREEMENT THIS agreement is entered into between ______________, hereinafter "Company" and _________________, hereinafter "Owner". Company and Owner do hereby covenant, contract and agree as follows: 1. Owner employs Company to offer for sale at public auction the following property: Entire contents of ______________________, including all personal property contained therein. 2. All property will be offered absolute to the highest bidder. The auction will be held on _______________ beginning at ______ a.m. 3. Owner agrees to pay Company a commission on all property in the amount of _____% on the highest bid. Owner will also pay advertising up to $_________________. 4. Company agrees to conduct an auction of the property described herein and to perform the following services: (a) Prepare all public advertisements of the Auction, publish same in a newspaper circulated in the County where the property is located and distribute circulars in various places in the County where the property is located. (b) Provide all labor to conduct the auction. (c) Pay all labor and other related expenses in connection with conducting the auction. Loading expenses shall be the responsibility of Buyers. (d) Assist Owner in the preparation and showing of the property to be sold. (e) Deposit all auction funds received and disburse unto owner said funds collected, less commissions earned and advertising, upon all good checks clearing said account in accordance with the laws of the state of ________. 5.
— 5. If property is sold without reserve for a fixed sum of dollars a. In such case the auctioneers shall proceed to sell the same, without reserve, to the highest bidder, and the owner shall, in the absence of satisfactory offer at the sale, have the option of purchasing the same back, at the price which he paid for it. B. After such auction company has been successful, all property remaining at the auction company's disposal shall be sold at public auction by the owner, at the option of the owner, for the next highest offer. If the highest offer is accepted, company will proceed to sell it for the amount of the highest bid plus a commission on the full value of the lot sold to the highest bidder. C. If the highest offer is not accepted, the property may be offered to the highest bidder or other persons not having a prior interest in the property, according to the discretion of the auctioneers. D. The property shall not be offered at auction to the highest bidder who shall fail to comply with stipulated conditions, to the fullest extent permitted by law. D. The property offered to the highest bidder shall not be considered any other property than the lot offered for sale at the public sale. D. In any sale of property the value of which is between 100 and 999 the buyer shall pay all expenses and applicable taxes of such sale. For any sale of value of 500 to 999. Or up therewith the buyer shall pay all expenses in connection with such sale and pay the balance of fair costs in accordance with section 9-3b to the seller. If there is no buyer or if the highest bid is not accepted, the lot or lots sold as herein provided shall be by public auction in accordance with the uniform regulations for auctions. "2" means that we have to send a copy to the credit card company as well as send our credit card company a copy of this agreement. "3" means that we have to print the contract on the back of the documents we send to the credit card company. The credit card company has to print it on the back of its own documents as well. The credit card company has to send copies back of all documents they send to us. "4" means that the credit card company must fill out the credit card section on the back of each document sent to us, and sign them. If the credit card company accepts our documents, they have to return the documents, or we need to print new ones.
