AUCTION SERVICES AGREEMENT THIS agreement is entered into between ______________, hereinafter "Company" and _________________, hereinafter "Owner". Company and Owner do hereby covenant, contract and agree as follows: 1. Owner employs Company to offer for sale at public auction the following property: Entire contents of ______________________, including all personal property contained therein. 2. All property will be offered absolute to the highest bidder. The auction will be held on _______________ beginning at ______ a.m. 3. Owner agrees to pay Company a commission on all property in the amount of _____% on the highest bid. Owner will also pay advertising up to $_________________. 4. Company agrees to conduct an auction of the property described herein and to perform the following services: (a) Prepare all public advertisements of the Auction, publish same in a newspaper circulated in the County where the property is located and distribute circulars in various places in the County where the property is located. (b) Provide all labor to conduct the auction. (c) Pay all labor and other related expenses in connection with conducting the auction. Loading expenses shall be the responsibility of Buyers. (d) Assist Owner in the preparation and showing of the property to be sold. (e) Deposit all auction funds received and disburse unto owner said funds collected, less commissions earned and advertising, upon all good checks clearing said account in accordance with the laws of the state of ________. 5. No property will be withdrawn after this agreement is signed. 6.
