F or and in consideration of the mutual covenants contained in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Owner is the owner the following described automobile:  Make ____________________________  Model ____________________________  Year ____________________________  VIN ____________________________  Color ____________________________ 2. Owner is allowing Bailee use the car with the understanding that it will sometimes be driven by Owner's daughter ________________________ (name of daughter) who lives with Owner's ex-wife ________________________ (name of ex-wife) who is the Bailee herein. 3. Bailee hereby assumes all liability for theft, collision, fire, or damage regardless of who is driving the car. 4. Unless otherwise agreed in writing by the parties, all service, materials, and repairs in connection with the use and operation of the vehicle during the time Bailee is in possession of the car, including but not limited to gasoline, oil, batteries, repairs, maintenance, tires, and towing necessary for its proper use and operation, shall be at Bailee's expense. Bailee agrees to maintain the vehicle in accordance with all service intervals recommended by the manufacturer of the vehicle. Bailee shall take the vehicle to the appropriate factory-authorized dealer for all service and repairs under manufacturer's warranty. Owner shall not be liable for repairs, nor shall any such repairs be charged to Owner . 5. Insurance covering loss by (describe coverages required ) ________________ ______________________________________________________________________ _____________________________________________________________________, including collision, bodily injury, and property damage i n the amount of $__________ will be maintained by Bailee. 6.Bailee shall bear all risks of damage to or loss of the vehicle, or any portions of the vehicle, not covered by insurance. All replacements, repairs, or substitutions of parts or equipment shall be at the cost and expense of Bailee and shall be accessions to the vehicle. Bailee , at all times and at Bailee's expense, shall keep the vehicle in good working order, condition, and repair, reasonable wear and tear excepted. 7. Bailee agrees to indemnify Owner against all claims, losses, causes of action, and expenses, including attorney fees and legal expenses, arising from the use, maintenance, and operation of the vehicle by Bailee or __________________________ (name of daughter) , or anyone else with or without Bailee's permission. 8. Bailee does hereby release and discharge Bailee for any and all loss or damage, and any claim or damages resulting from the same, on account of injury to Bailee , ______________________________ (name of daughter) , or anyone else injured as a result of said vehicle and its driver. This release covers all injuries, even injury resulting in death of Bailee , ___________________________ (name of daughter) , or anyone injured as a result of said car being on public roads. 9. Owner may request return of the vehicle at any time, and said vehicle must be returned to Owner with five days.
