Agreement to Devise or Bequeath Property to Grantors Who Convey Property to Testator Agreement made __________________ (date) , between ________________________ (Name of Testator) , of _____________________________________________ (street address, city, county, state, zip code) , referred to herein as the Testator, and ________________________ (Name of Grantor 1) and ____________________ (Name of Grantor 2) , of _____________________________________________ (street address, city, county, state, zip code) , referred to herein as the Grantors. I. Execution of Deed. On or before __________________ (date) , Grantors agree to execute and deliver to Testator a valid __________________ (warranty or quitclaim) deed in which Testator is named as Grantee, and which conveys all the right, title, and interest of Grantors in the following described property to Testator: _______________________________________________________________ (legal description of property) . II. Marketable Title. On or before __________________ (date) , Grantors agree to deliver to Testator documentary evidence showing that Grantors have marketable title to the above-described property. III. Execution of Will. On or before __________________ (date) , Testator agrees to execute and deliver to Grantors a valid Will in which Testator bequeaths and devises, in equal shares, to Grantors, all of Testator's right, title, and interest in any and all real and personal property which _______ (he/she) may have at the time of _______ (his/her) death. IV. Revocation of Prior Wills and Codicils. Testator agrees that a clause revoking any and all prior wills and codicils will be included in Testator's Will. V. Restriction on Revocation of Will. Testator agrees not to revoke the Will which _______ (he/she) agrees to execute pursuant to this Agreement. VI. Approval of Will by Attorney. A. On or before __________________ (date) , Grantors agree to submit the Will executed by Testator to their attorney for examination and approval or rejection. B. If their attorney does not approve the Will, the attorney must, within __________________ (number) days after receipt of the Will, notify Testator in writing of the specific reasons why _______ (he/she) refuses to approve the Will. C. Testator, within __________________ (number) days after receipt of the attorney's written notice, will execute and deliver to ____________________ (name of attorney) a Will the contents of which correct all of the objections to the original will which are specified in the attorney's written notice. VII. Approval of Title and Deed by Attorney. A. On or before __________________ (date) , Testator agrees to submit the documentary evidence of marketable title to the property and the deed to Testator's attorney for examination and approval or rejection. B. If the attorney does not approve the title and deed, the attorney must, within __________________ (number) days after receipt of the documents, notify Grantors in writing of the specific reasons why _______ (he/she) refuses to approve the title or deed. C. Grantors, within __________________ (number) days after receipt of the attorney's written notice, will submit to the attorney documentary evidence, a deed, or documentary evidence and a deed, the contents of which correct all of the objections specified in the attorney's written notice. VIII. Custody of Will. Death of Grantor Prior to Grantor. A.
