In its opinion, the Court stated: As to the plaintiffs breach of contract claim, it is well settled that a complaint asserting such a cause of action must specify the provisions of the contract upon which the claim is based. (citations omitted). Here, the complaint fails to even specify the contract which was allegedly breached, much less the particular provision involved. Although, in his opposition papers, the plaintiff suggests that the defendant breached the promise in its literature and publications to allow alumni access to the campus, he has nevertheless failed to identify any such publication containing any such promise. Similarly, although the plaintiff contends that the process which the defendant followed in banning him from campus violated his rights as a Columbia graduate, he has not identified any documents under which such rights are found. (Emphasis added). 2. Plaintiff respectfully brings to the Court’s attention Exhibits 12 and 13 referred to in the Complaint. Exhibit 12 is a copy of the Columbia Alumni Association Brochure which grants to alumni (like Plaintiff): “Membership at the Dodge Physical Fitness Center, located on the Morningside Heights campus, gives alumni and their families access to Columbia's pool, indoor track, squash courts, weight room and other facilities.”Exhibit 13 is a copy of The Rules of University Conduct, which were not followed by the University in Plaintiff’s case. 3. Since Plaintiff did in fact identify documents under upon which his breach of contract claims are based, Plaintiff respectfully moves the Court to reconsider its Opinion and Judgment in this regard and to modify said Opinion and Judgment in such a way as to allow Plaintiff’s breach of contract claims to proceed in this matter.
