Whereas, Caretaker is in the business of taking care of pets while the owner is
away; and
Whereas, Caretaker takes care of pets in his/her home or at the home of the

Whereas, Caretaker will only care for said pet if this Release, Waiver, and
Assumption of Risk Agreement is executed by Owner;
Now, therefore, for and in consideration of Caretaker’s agreeing to care for said
pet of Owner during the period of time stated above, the undersigned Owner hereby
releases Caretaker from all liability to Owner for any loss or damage to property
(including, but not limited to pet), physical injury or death (including, but not limited to
pet), whether caused by Caretaker or otherwise that results, directly or indirectly from
Caretaker’s taking care of said pet at said address during the period of time set forth
above. Owner further agrees to indemnify, save and hold Caretaker harmless from any
loss, liability, attorneys’ fees, damage, or costs that Caretaker may incur, or that may
arise out of, or relate to Caretaker’s taking care of said pet at said address during the
period of time set forth above, whether caused by the negligence of Caretaker or
otherwise, and Owner does hereby assume the risk of any such loss or damage.
Any dispute arising out of this agreement shall be resolved by binding arbitration
of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select
one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected
shall arbitrate said dispute. The arbitration shall be governed by the rules of the American
Arbitration Association then in force and effect.
