SALT WATER: DISPOSAL, STORAGE, AND HANDLING
Form 1. Lessee’s operations on the lease premises shall be conducted in such a manner as to
prevent the contamination of any and all water in, on, or under the lease premises and any and all
subsurface water bearing strata or formations. Lessee shall prevent the contamination of the
surface of the lease premises from salt water pollution or any other contaminating substanc es
flowing over or seeping onto or into the lease premises as a result of Lessee’s operations.
Form 2.
Any salt water produced from wells drilled on this Lease shall not be disposed of on the
lease premises unless it is injected into formations or depths below the deepest fresh water
bearing formation under the lease premises. Lessee shall not use salt water pits of a ny type on
the lands subject to this Lease, and shall dispose of all salt water, either off the lease premises or
by injection into a formation under the lease premises which is suitable for receivi ng salt water,
without the possibility of it escaping or migrating to the surface or escaping or migrat ing into any
fresh water sand or formation. Lessee shall not dispose of salt water or other waste liquids on
the lease premises which has been produced from lands not covered by this Lease.
Form 3.
If salt water is produced from any well on the lease premises, it may be reinjecte d into a
formation below all fresh water bearing formations under the lease premises. In all
circumstances, salt water and any other deleterious substances shall be handled in a manner that
will not pollute fresh water or cause damage to the surface. No salt water shall be returned into
any well unless: (a) it is a by-product of a well drilled on the lease premises; or, (b) Lessee has
obtained the prior written consent of Lessor.
Form 4.
Salt water, sulfur water, chemicals, sludge, oil, or other deleterious or polluting
substances shall not be stored or placed in surface pits for any extended length of time. Any pit
in which substances are placed or stored must be lined with an impervious material and
constructed and maintained to prevent any escape of these substances. Lessee shall prote ct all
fresh water zones and sources from contamination or pollution by any deleterious or polluting
substances which may reduce the quality of ground water for human or animal consumption, or
agricultural purposes.
Form 5. In all its operations, Lessee shall use its best efforts to protect the soil and al l fresh water
bearing strata and formations from any damage or pollution as a result of salt water, oil ,
chemicals, deleterious, or polluting substances escaping, leaking, or being deposited onto or into
the soil or into fresh water bearing strata or formations.
Form 6.Lessee shall not drill or convert any well or well bore on the lease premises to a salt water
disposal well, and shall not dispose of salt water into any well or well bores on the lea se
premises.
Form 7. Lessee shall comply with all governmental rules and regulations pertaining to disposal of
salt water and other noxious fluids produced from the lease premises, and pay Lessor for any
damages caused by the escape of such fluids.
Form 8. Lessee shall dispose of salt water, waste oil, and all other fluids and polluting substanc es
in such a manner to prevent its seepage into the soil, in a manner that complie s with all
applicable state and federal regulations. No surface pit shall be used for the disposal of salt
water, waste oil, or other fluids and polluting substances produced from the lease premises. No
salt water or disposal wells shall be drilled on the lease premises, except to dispose of salt water
actually produced from wells on the lease premises. No salt water produced from any lands
other than those covered by this Lease shall be injected into any disposal wells on the lease
premises.
Form 9. Lessee shall not permit waste oil, salt water, deleterious substances, or any drilli ng mud
to be stored or discharged on the surface of the lease premises, or to run or flow into Lessor’s
stock tanks or any natural creek, stream, river, or other body of water. Salt water produced from
a well located on the lease premises, or on land pooled with the lease premises, may be disposed
of in subsurface formations, as authorized by the governmental agency having jurisdiction, but
only as long as this Lease is still in full force and effect. Lessee shall construct reserve pits and
other disposal facilities required by state or federal regulations, necessary to confine and dispose
of salt water, waste oil and other deleterious substances produced from wells located on the lease
premises.
Form 10. Lessee shall dispose of salt water or other substances resulting from operations on the
lease premises, and to conduct operations in such a manner to not pollute the surface, surface
water, or underground water, on, in, or under the lease premises.
Form 11.
No salt water produced from wells drilled on this Lease shall be disposed of on the lease
premises.
Form 12.
At no time shall substantial quantities of salt water be stored or placed in surface pits. All
pits into which salt water is placed shall be constructed and sealed in a water-tight manner so that
salt water cannot escape through or over the pits. If substantial quantities of salt wa ter are
produced, it shall be transported off the lease premises or reinjected in a formation beneath the
lease premises, which is below any fresh water bearing formations. Regardless of the
circumstances, salt water shall be handled in such a manner so as not to pollute fresh water.
Form 13. All of Lessee’s drilling, development, and production operations on the lease premises
shall be conducted in such a manner that Lessee shall use every reasonable and cust omary means
to prevent the contamination of any and all waters in, on, or under the lease premises, whe ther in
surface tanks, any other type of storage, in creek beds or river beds, and any other surface a nd
subsurface bearing strata or formations. Lessee shall prevent contamination of the surface of the
lease premises from salt water or other contaminating substances flowing over or seeping ont o or
into the lease premises because of Lessee’s operations.
Form 14. Lessee, its successors and assigns, shall not dispose of or inject any off-premises salt
water on the lands covered by this Lease without the written consent of Lessor. Lessee furt her
agrees that all disposal or injection of salt water will be done according to t he rules and
regulations of the _______________________.
Form 15. No water produced from wells located on any other land may be injected into wells
located on the land without written permission from Lessor.
Form 16. The use of salt water injection by Lessee, its successors or assigns, shall be prohibited
without the express written consent of Lessor. Lessee shall exercise due diligence to pre vent any
salt water leaks or spills on the premises and will take whatever precautions are necessary to
prevent salt water from spilling into draws, streams, or ponds, and will construct a dike or terrace
around any salt water storage facilities to prevent leaks or spills from damaging surrounding
lands or entering draws (dry or wet), creeks, streams, or waterways. Lessee, its successors or
assigns, shall be strictly liable to Lessor for any and all damages resulting to L essor by reason of
salt water pollution and spills due to Lessee’s operations, and regardless of fault or negligenc e or
the absence of it on Lessee’s part.
Form 17.Any salt water produced from the wells drilled on this Lease shall not be disposed of on
the leased premises or on land owned by Lessor unless the salt water is injected into formations
located below the depth of the formations bearing fresh water.
Form 18. Lessee shall not establish, utilize, or maintain any facilities for the surface or subsurface
disposal of salt water on the land covered by this Lease, without the prior written conse nt of
Lessor. However, Lessor shall have the right to dispose of or use, off premises, all salt water t hat
may be produced from the leased premises.
Form 19. Lessee agrees to dispose of all salt water in connection with the drilling and production of
oil and gas on the leased premises without substantial damage to the surface or any domestic
fresh water supply. Lessor agrees that Lessee may use any dry hole previously or later drilled for
disposal of salt water produced from Lessor’s lands.
Form 20. If salt water is produced, the same may be reinjected into a formation which is below all
fresh water bearing formations, and in all events, salt water and other deleterious substanc es shall
be handled in a manner so as not to pollute fresh water or cause damage to the surface of the
lands. No salt water shall be returned into any well without prior written consent of Lessor
unless salt water is a by-product of a well drilled on the acreage covered by this Lease. If
Lessee’s operations shall cause pollution to any fresh water or damage to the surface, t hen
Lessee shall be liable in damages to Lessor for any losses suffered or incurred by Lessor and/ or
the owner of the surface. Further, it is agreed that Lessee shall make every reasonable effort to
case off fresh water formations in the bore hole of any well drilled or converted for salt wa ter
disposal purposes, complying at all times with applicable governmental regulations.
Form 21. Lessee shall dispose of all salt water produced from the Lease in a manner so as to
protect from salt water pollution the surface of the land covered by this Lease, inc luding surface
water and the fresh water sands beneath the surface of the land, either by injecting the salt water
in a zone beneath _____ feet below the surface of the land, or by transporting the sale water to a
suitable disposal facility located off the land covered by this Lease.
Form 22.The operations of the Lessee on the leased premises shall be conducted in such a manne r
that the Lessee shall prevent the contamination of any and all waters in, under, a nd on the land,
whether in surface tanks or any other type of storage, in creek beds or river beds, and any and a ll
surface and subsurface water bearing strata formation, resulting from Lessee’s drilling,
development and production operations. Lessee shall prevent contamination of the surface of t he
land from salt water or other contaminating substances flowing over or seeping onto such land
because of Lessee’s operations.
