Agreement with Church PianistPage 1 of 4 Agreement with Church Pianist Employment agreement made this day of , 20 , between , a Sec. 501(c)(3) organization of the (Name of Church) Internal Revenue Code, a nonprofit Church Corporation organized and existing under the laws of , with its principal office located at (State) , referred to herein Church, and (Street Address, City, County, State, Zip Code) of , (Name of Pianist) (Street Address, City, County, State, Zip Code) referred to herein Pianist. For and in consideration of the mutual covenants contained in this Agreement, and other good and valuable consideration, the parties agree as follows: I. Employment. Church employs, engages, and hires Musician as the Church Pianist to: enhance the music ministry of Church by providing musical leadership and accompaniment for the congregation and Traditional Choir; promote the spiritual life of the congregation through the music ministry; be familiar with and to support the overall vision and goals of the congregation;  be supportive of the pastor; work collaboratively and communicate frequently with the pastor to coordinate music with Scriptural teaching of the Church; bring concerns directly to the Pastor; meet at least once per month to discuss with the Pastor the direction of the music ministry of Church; and be available to the Worship Team, Pianist accepts this Agreement and agrees to such hiring, engagement, and employment, subject to the general supervision and pursuant to the orders, advice, and direction of Church. II. Church agrees to prayerfully support ministry of the Pianist among us, and to:  advocate for the music program; meet at least once per month to discuss with the Pastor the direction of the music ministry of Church; be responsive to the concerns of the Pianist; work with the church to provide adequate space for the music program; and keep all musical instruments in good working order Agreement with Church PianistPage 2 of 4 III. Specific and Primary Responsibilities of Pianist. Provide piano accompaniment for the congregation and choir during the traditional Sunday morning worship services and at choir rehearsal;  Work with the Pastor to choose music for worship;  Be available to work with the Worship Team regarding the role of music in the ministry of the Church;  Schedule appropriate rehearsals;  Recruit and prepare substitutes to perform during scheduled absences, in consultation with the Pastor; and  Select music, providing music and choir direction for the Traditional Worship, Choir Rehearsal and personal practice time; and  Such additional duties as directed by the Pastor. IV. Compensation. A. The gross starting salary of the Pianist is $ per week. B. As a paid employee of the Church, the Pianist will have state and federal tax and Social Security withholdings deducted from the paycheck. V. Vacations, Holidays, Personal Days and Leaves of Absence A. Holidays. Pianist will be entitled to paid holidays each year (Number) plus personal days. Church will notify the Pianist as much in advance as (Number) practical with respect to the holiday schedule. The holidays which are generally observed by the Church are as follows: New Year's Day, Washington's Birthday, Good Friday, Memorial Day, Independence Day, Labor Day, Columbus Day, Thanksgiving Day, the Friday following Thanksgiving, and the day following Christmas Day. Additional holidays may be allowed in connection with holidays which fall on weekends. B. Personal Days. Personal days are to be scheduled in advance to the mutual convenience of the Church and the Pianist. Such personal days must be taken during the calendar year and cannot be carried forward into the next year. VI. Vacation and other Absences: A. Sickness. The employee is allowed sick days per year. Sick days are (Number) not cumulative and may not be carried from year to year. B. Maternity Leave. Maternity leave is treated as any other short term disability. This means that the employee will be paid in the same manner as if the employee were ill or otherwise disabled. Agreement with Church PianistPage 3 of 4 C. Jury Duty. Employees will be given time off, with pay, for jury duty up to three weeks in any given year. D. Vacation allowance. Church shall provide Pianist with paid vacation of (Number) days each year during the term of this Agreement, the time for Pianist to take such vacation shall be determined by mutual agreement between Church and Pianist. E. Emergency Leave. If a member of the immediate family of Pianist dies or becomes critically ill, Pianist will be allowed up to days of leave with pay. (Number) Additional time may be granted, without pay, upon approval of the Church. VII.Church shall continue to employ Pianist for such a time as Church is in need of, or desirous of, the services of Pianist. It is agreed between Church and Pianist that the duration of employment is unspecified and solely rests in the discretion of Church. VIII. Severability. The invalidity of any portion of this Agreement will not and shall not be deemed to affect the validity of any other provision. If any provision of this Agreement is held to be invalid, the parties agree that the remaining provisions shall be deemed to be in full force and effect as if they had been executed by both parties subsequent to the expungement of the invalid provision. IX. No Waiver. The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred. X. Governing Law. This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of . (Name of State) XI. Notices. Unless provided herein to the contrary, any notice provided for or concerning this Agreement shall be in writing and shall be deemed sufficiently given when sent by certified or registered mail if sent to the respective address of each party as set forth at the beginning of this Agreement. XII. Mandatory Arbitration. Notwithstanding the foregoing, and anything herein to the contrary, any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. Agreement with Church PianistPage 4 of 4 18. Entire Agreement. This Agreement shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding upon either party except to the extent incorporated in this Agreement. 19. Modification of Agreement. Any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by each party or an authorized representative of each party. 20. Assignment of Rights. The rights of each party under this Agreement are personal to that party and may not be assigned or transferred to any other person, firm, corporation, or other entity without the prior, express, and written consent of the other party.
