By misrepresentations made by Defendant to Plaintiff, Defendant induced Plaintiff to grant him the Power of Attorney to sell said Property. Defendant failed to tell Plaintiff that Defendant had made a deal with _____________________ (Name of Purchaser) , hereinafter called Purchaser , which involved Defendant being paid the sum of $_______________ as a finders fee and for having title to the Property transferred to Purchaser. Prior to naming Defendant as his attorney in fact, Defendant represented to Plaintiff that the sale’s price of the Property would be $____________ less than stated in the Contract for Purchase, said amount to be $___________ less than the fair market value of the Property and the sales price stated in the Contract. Defendant’s representations to Plaintiff to get Plaintiff to execute said Power of Attorney were false; D efendant knew said representations were false; Defendant made such representations to deceive Plaintiff; Plaintiff was deceived; resulting in damages to Plaintiff. 5. Prior to the sale of the Property, and after Plaintiff had paid $__________ for a survey, title search and termite inspection pursuant to the Contract, Plaintiff leaned of the fraud of Defendant and refused to go forward with the sale. After learning of Defendant’s fraud, the said Purchaser agreed to void the Contract for sale of the Property signed by Defendant pursuant to said Power of Attorney A copy of said Contract is attached hereto as Exhibit A and a copy of the Power of Attorney is attached hereto as Exhibit B . WHEREFORE, Plaintiff requests: 1. Judgment against Defendant for rescission of the Power of Attorney; 2. Judgment against Defendant for $_________ for the cost of said survey, title search and termite inspection; 3. Plaintiff's costs of suit; and 4.
