IN THE CHANCERY COURT OF       COUNTY, MISSISSIPPI IN THE MATTER OF THE ESTATE OF       NO.       COMPLAINT TO PROBATE WILL IN COMMON FORM AND TO APPOINT ADMINISTRATOR WITH WILL ANNEXED COMES COMPLAINANT,       , and respectively would show unto the Court the following: 1. The Decedent,       , departed this life on the       day of       , 20       , and at such time, maintained a fixed residence in       County, Mississippi. 2. The Decedent,       , on the       day of       , 20       , made, published and declared an instrument in writing purporting to be his/her Last Will and Testament. A copy is attached hereto as Exhibit "       " and the original of said instrument is presented to the Court for probate in common form. 3. The Decedent made, published, declared and executed said instrument being of sound and disposing mind and memory and of legal age to devise. Said instrument is in conformity with the requirements of law and constitutes the true and lawful Last Will and Testament of       , Decedent. 4. Complainant would show that said instruments of writing name       or       as Executor(trix) .       is under a Conservatorship of this Court and is incapable of serving as Executrix.       has retired and has declined to serve as Executor(trix) as indicated by the attached exhibit "       ". Complainant is over the age of eighteen (18) years, of sound mind, and not the convict of a felony and is a fit, suitable and proper person to act as Administrator With Will Annexed and he/she is willing to accept the appointment. Complainant would show that he/she should be appointed as the Administrator/Administratrix With Will Annexed of the Estate of the Deceased and that Letters of Administration be issued to same in the Probate of the Will in common form. The Will waives inventory, appraisal and accounting. 5. The Decedent left an estate consisting of real and personal property and Complainant would show that said instruments waive the giving and filing of bond and accounting and Complainant would show that the appointment of appraisers to locate, inventory and appraise the estate, the filing of inventory, and accounting should be dispensed with as they have been waived. 6. Affidavits of two subscribing witnesses are attached as Exhibit "       ". 7. Complainant further contends that the only creditors of the deceased to the personal knowledge of Complainant are the following:       $             $             $       And that he/she shall personally give said creditors notice to probate claims.
