- 1 - Contract for Deed CONTRACT FOR DEED THIS DAY this agreement is entered into by and between _______________________, hereinafter referred to as "SELLER", whether one or more, and _______________________, hereinafter referred to as "PURCHASER", whether one or more, on the terms and conditions and for the purposes hereinafter set forth: 1. SALE OF PROPERTY For and in consideration of TEN DOLLARS ($10.00) and other good and valuable considerations the receipt and sufficiency of which is hereby acknowledged, Seller does hereby agree to convey, sell, assign, transfer and set over unto Purchaser, the following property situated in ___________________ County, State of Wisconsin, said property being described as follows: (Type description or attach description as exhibit "A") Together with all rights of ownership associated with the property, including, but not limited to, all easements and rights benefiting the premises, whether or not such easements and rights are of record, and all tenements, hereditaments, improvements and appurtenances, including all lighting fixtures, plumbing fixtures, shades, venetian blinds, curtain rods, storm windows, storm doors, screens, awnings, if any, and ____________________________________________now on the premises. SUBJECT TO all recorded easements, rights-of-way, conditions, encumbrances and limitations and to all applicable building and use restrictions, zoning laws and ordinances, if any, affecting the property.
(2) said sale contract, the sale-offering and the terms, conditions, provisions, terms and provisions of the warranty or guaranty and any additional terms and conditions made hereunder must be in writing, signed by both parties, notarized, notarized, executed by all persons interested in the property at the time of execution, and be substantially in the form set forth at a‑1 of exhibit e, hereto filed. 2. Sellers obligations as to maintenance. Subject to and in accordance with the terms and conditions set forth in and pursuant to these conditions of sale, sellers shall provide to buyer, during the term of this sale contract, maintenance of the property. Said maintenance means all services necessary and reasonable for maintenance including but not limited to elevator service, fire department service, elevator service and other elevator related labor costs. 3. Ownership of the property. Buyer shall have the title to and all the rights of ownership required. 4. Disposition of property as set forth below. A. Within thirty (30) days after execution of this sale contract sale-offering purchase contract or this deed, buyer should give written notice to seller stating that the property is not to be removed by the purchaser under any circumstances except for such actions as are reasonably necessary and reasonable to maintain such property. This notice is a required and irrevocable condition to the acceptance of the property by purchaser. In case any person fails to comply with this notice, the property shall be held in the name of the seller and sold by him or her as the purchaser desires, provided, however, that said buyer shall not be liable to seller for the value of such property in any event after twelve (12) months from receipt of the notice of noncompliance by said person. B. Buyer shall have the right to withdraw, with or without notice, without penalty and without any obligation to pay any fee. C. Buyer shall not be entitled to damages or other relief in favor of seller. D. To exercise the right to withdraw, buyer shall give notice of such withdrawal as directed in these conditions of sale. E. Within sixty (60) days after execution of this sale contract sale-offering purchase contract or this deed, buyer may either sell or transfer, in which event buyer shall, upon written notice to seller by at least 12:00 of the business day on the fifth day of the sale-offering purchase contract or this deed, return the property as herein described to the seller.
