The Court reviewed the Affidavit in Support of Decree. Petitioner and Respondent have entered into a Stipulation in this matter. Upon such, the court makes the following: FINDINGS OF FACT 1. The Court finds that it has jurisdiction of the parties and the subject matter of the Complaint. 2. Petitioner and Respondent have been bona fide residents of ______________ County, State of Utah for more than three (3) months next preceding the filing of the complaint herein. 3. All matters involving property of the marriage, both real and personal, have been resolved and the terms agreed to in the Separation and Property Settlement Agreement previously filed with this Court in connection with this proceeding. All debts have likewise been resolved by the parties in the Separation and Property Settlement Agreement. Said agreement is fair and equitable to both parties. 7. There is no reasonable prospect of reconciliation of this marriage. 8. In the event either party fails to perform his or her obligations under the Decree of Dissolution of Marriage, such person shall be required to pay all costs and attorney fees of the other party incurred in enforcing the terms of the Decree of Divorce. 9. Each party is ordered to execute and deliver to the other party without cost any documents necessary to implement the provisions of this Decree of Dissolution of Marriage. CONCLUSIONS OF LAW Based upon the foregoing Findings of Fact, the court concludes as a matter of law that the Petitioner is entitled to a Decree of Dissolution of Marriage from the Respondent on the ground of irreconcilable differences.
