Page 1 of 2 PARTIAL RELEASE OF EASEMENT(S) STATE: COUNTY: _____, whose address is _____ (the “Grantor”), for valuable consideration received from _____, whose address is _____ (the “Grantee”), quitclaims, releases, and surrenders to Grantee, and Grantee’s successors and assigns, all of Grantor’s easement rights, title, and interests in and to those certain lands (the “Premises”) situated in _____ County, _____, more fully described and shown on Exhibit “A,” attached to and made a part of this Partial Release. It is the intent and purpose of this Partial Release to quitclaim, release, and surrender the Premises from the lien and operation of those certain pipeline easement(s) and right(s) of way, described as follows: Original Grantee Date Recording Info. Grantor excepts and reserves from this Partial Release, a permanent easement and ri ght of way for pipelines and appurtenances, as more fully shown and described on Exhibit “A,” intending to describe a strip of land ____ in width containing the pipeline(s) as now laid on, over, through, in, and across the premises. Grantee confirms and acknowledges the validity of the Easement and Right(s) of Way within the limits of that strip, the locat ion of it on and through Grantee’s Premises, and the location of the pipeline(s) constructed and now in operation on the pipeline easement, including the right of Grantor, its successors and assigns, without the pa yment of additional consideration, to construct, maintain, operate, replace, remove, and cha nge the size of one additional pipeline and its appurtenances at any time or times in the future. 1. As part of the consideration for this Partial Release, Grantee covenants and agrees for himself/herself/themselves, his/her/their successors and assigns, with Grantor, its successors and assigns, as follows: a. Not to place, or to permit others to place, any paving or hard-surfacing (including, but not limited to, what is commonly referred to in the trade as “black-topping” and/or “tar and chips”) for driveways, roadways, or other purposes, or erect or permit the placement of any buildings, structures, objects or material of any kind (including, but not limited to, trees, shrubs, fences, swimming pools, or waste disposal systems) over, under or on the permanent easement and right of way strip reserved by Grantor, without the prior written consent of Grantor; and Page 2 of 2 b. Not to remove any fill dirt from the easement and right-of-way strip or deposit any fill or other material of any kind without the prior written consent of Grantor. 2. Nothing contained in this Partial Release shall in any way alter, modify, change, or disturb the rights of Grantor as originally conveyed by the easement grant(s) dated _____, and recorded as set forth above, in and to: (a) the right of way strip excepted and reserved; and, (b) the remainder of the property, if any, encumbered by the original easement grants and not otherwise quitclaimed, released, and surrendered. 3. This Partial Release shall be binding on and inure to the benefit of the successors and assigns of the parties, including any persons or entity claiming under or through Grantee(s), or at any time owning, occupying, or using the Premises or any part of it. 4.
