Spouses' Mutual Disclaimer of Interest in each Other's Property with Provision for Use of Family Residence by one Spouse Agreement made on the ___________________ (date) , between __________________ (Name of Wife) of _____________________________________________________________ ______________ (street address, city, county, state, zip code) , referred to herein as Wife , and ___________________ (Name of Husband) , of __________________________________ ______________________________ (street address, city, county, state, zip code) , referred to herein as Husband . The family residence previously occupied by the parties and located at of ____________ _____________________________________ (street address, city, county, state, zip code) , now owned as joint tenants with full rights of survivorship and not as tenants in common, shall now be owned by the parties as tenants in common. A deed properly drawn and executed and which reflects the change in the status of ownership of the family residence shall be recorded in the Office of the Recorder of Deeds of __________________ (name of county) County, _________________ (name of State) , within days from the date of this Agreement. Husband shall be entitled to occupy and use the residence without payment of rent to Wife for so long as he shall remain unmarried. During the period of occupancy of the premises by Husband, Husband shall pay all taxes coming due and all promissory note payments due that are secured by a mortgage or deed of trust on the residence. Husband shall also pay all utilities . Such payments by Husband shall be in addition to other payments for the support and maintenance of Wife otherwise provided for in this Agreement. On the remarriage of Husband or his sooner vacating the premises at his option, the premises shall be treated and dealt with in all respects as property held in common by the parties.
