GAS PIPELINE PUBLIC ROAD ACCESS ORDINANCE In order to protect, the health, safety and welfare of the citizens and driving public of County, , and Pursuant to the general police powers statutory land-use Authorities of county governments, the County Board of Supervisors hereby adopts the following ordinance on an emergency basis to take affect immediately for a duration of sixty days within which time a public notice and public hearing of a permanent ordinance shall be conducted. No person, company or entity shall place or cause to be placed gas pipeline(s) Upon, over, through or under the county roads and highways of County, , without first obtaining a land umm permit from the county building inspector upon express approval by the County Board of Supervisors, applications for such permit shall contain all technical information that the applicant has submitted to Stat e and federal regulatory agencies including, but not limited to a plat of the exact pipeline location, a traffic control plan, and an engineer's certification stating that the application plans meet all requirements that are imposed by the Department of Transportation for installing similar pipeline upon, over, through or under state roadway. An application and site inspection fee of $500.00 is required for each application and each pipeline shall require a separate application and fee. Violation of this ordinance shall constitute a misdemeanor wit h a penalty not to exceed 12 months in jail and a fine not to exceed $1,000.00 for each day of violation. Such criminal charges may be proceed against any person involved in the pipeline installation including t hose persons deemed to have authorized such installation, in addition, civil penalties not to exceed 10,000.00 per day may be imposed by County by filing of a petition in a court of competent jurisdiction.
