NOTICE OF CLAIM OF MINERAL INTEREST(Dormant Mineral Interest) At least nineteen (19) states have been identified as having enacted legislati on pertaining to “dormant interest.” These states are California, Florida, Georgia, Illinois, India na, Kansas, Kentucky, Louisiana, Minnesota, Michigan, Nebraska, North Carolina, North Dakota, Oregon, South Dakota, Tennessee, Virginia, Washington, and Wisconsin. The dormant interest statutes in these states, providing for an owners interest to be terminated, or extinguished for non-use, vary from state-to-state. Just as the period of time of non-use giving rise to the possibility an owner’s rights may be extinguished vary from state-to-state, the requirements of the contents of a Notice, i f permissible, also varies from state-to-state. The form of Notice provided is not guaranteed to meet the requirements of each state having a dormant mineral interest statute. It is strongly recommended that before preparing and filing any notice, that the owner determine if the state recognizes the validity of a notice, the time when a notice must be filed, and the specific required content of a notice.
