Page 1 of 2 SURFACE EASEMENT(For Meter Station) STATE: COUNTY: The undersigned, _____ (the “Grantor”), whose address is _____, for valuable consideration, the receipt and sufficiency of which is acknowledged, grants, bargains, sells a nd conveys to _____, whose address is _____, its successors and assigns (the “Grantee”), an easement in and to the tract of land described below for the exclusive use and oc cupancy and for the purpose of erecting and constructing, and maintaining, operating, altering, repairing, and removing a meter station and all appurtenances and equipment used, useful, or convenient i n connection with it. The land is situated in _____ County, _____, and described as follows: (Description of Land) Grantee shall have all rights of ingress and egress to those lands across adjacent lands of Grantor, at convenient points, for the enjoyment of the uses, rights, and privileges. Grantor releases a nd waives all rights under and by virtue of any applicable homestead exemption laws. Grantee shall have the right to fence and enclose the tract of land on which the m eter station is located within a single fence or to fence any of the facilities installed on it in separate enclosures, and all other rights and benefits necessary or convenient for the full enjoyment and use of it, including, but not by way of limitation, the right to erect a building or buildings and radio facilities, the right to install pipelines, valves, conduits and meter runs above and below the surface. Grantee shall have the right to select the route or location, and the right , from time to time, to cut and remove all trees, undergrowth, and other obstructions, whether on the described tract of land or adjacent to it, which may injure, endanger, or interfere with the rights granted by this Easement. Grantee shall pay Grantor the reasonable value of any trees, undergrowth, or other obstructions cut or removed from any area adjacent to the described tract of land. This Easement is granted to Grantee, its successors and assigns, until a meter station or other facility of Grantee shall be constructed on it, and so long thereafter as a meter station or other facility of Grantee may be maintained on it. Grantor binds itself, its succe ssors, heirs, and assigns to warrant and forever defend all and singular the premises to Grantee, its succe ssors and assigns, against every person whomsoever lawfully claiming, or to claim the same, or a ny part thereof, by, through and under Grantor. The rights and interests of Grantee may be assigned in whole or in part.
