© 2017 - Cottonwood Equestrian Publications RELEASE OF LIABILITY OWNER/RIDER WITNESS THIS AGREEMENT this ______ day of _________________, 20__, by and between _______________, hereinafter referred to as MANAGER and ________________________, hereinafter referred to as RIDER. For consideration received, and in return for the use, today and on all future dates of the property, facilities and services of Manager, Rider, Rider's heirs, assigns, and representatives, hereby agree as follows: 1. Inherent Risks and Assumption of Risk. The undersigned acknowledges there are inherent risks associated with equine activities such as described below, and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include, but are not limited to the propensity of equines to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equine’s reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability. Rider acknowledges that horses, by their very nature are unpredictable and subject to animal whim. Rider assumes all risks in connection therewith, and expressly waives any claims for any injury or loss arising therefrom. Rider agrees to abide by and follow Manager's rules and regulations which, shall be posted and/or available from time to time. Rider further acknowledges that the behavior of any animal is contingent to some extent upon the ability of Rider. Rider assumes all risks therefor and warrants a full and fair disclosure of Rider's abilities has been made to Manager. Rider expressly releases Manager from any and all claims for personal injury or property damage, even if caused by negligence (if allowed by the laws of this State) by Manager or its representatives, agents or employees. The risks and hazards described herein are inherent in equine activities and will be no different for the following event(s): (i) an event in which management and rider make a commitment to undertake horse riding in conjunction with the performance of a live equestrian exhibition, such as horse shows, bull riding, or circus performance. Management and rider further agree that the foregoing will require additional care and attention by manager and rider which may include, but is not limited to, providing management with the horse(s) and additional horses. Rider agrees to take responsibility for the horse(s) and its training and behavior at all times while on the property for which the rider is the property owner. Section 2. Rider agrees that, and agrees that rider understands and acknowledges the following: (a) the presence of any or all of those listed above on the property on which the event is scheduled or in any manner associated with this event. (b) riders must be of legal age (at least seventeen years old). (c) riders must show their ID card to management. (d) riders may not enter the premises without the express consent of the property owner. Section 3. Rider agrees that, and agrees that rider understands and acknowledges the following: (a) the property manager and all property used by manager for live activities is under the control of the property manager. There cannot be any interruption of such live activities by riders, nor shall the property manager authorize any persons to work or engage the use of any equipment in any manner in which such work or activity is conducted. Riders must cooperate with management in an effort to maintain the security of the property without jeopardizing the safety of any participant or others. (b) a rider may not ride on or have access to any portion of the premises (except through the proper gates) that is not in use by the property owner, and no rider may work in the building where activities take place. Section 4. Rider agrees that, and agrees that rider understands and acknowledges the following: (a) the property manager has the discretion to deny entry to any person, without notice, or suspend or revoke privileges of any such person, without notice, to cause the property to be available for use or inspection by management and other riders, and to cause the property to be available to manage and rider and/or others for business or promotional activity, by any or all appropriate means.
