CONTRATO DE ARRENDAMIENTO DE VIVIENDA
El presente Contrato de Arrendamiento de Vivienda (en adelante denominado “Arrendamiento” se celebra a los ___ días del
mes de ___ de 20___, entre el Locador: ______________________________________, (en adelante denominado
“Arrendador”),
y
el/los
Locatarario(s):
_________________________,
___________________________,
__________________________, y _________________. Todos los Locatarios (en adelante denominados conjuntamente
“Arrendatario”), están obligados conjunta, separada e individualmente por los términos y condiciones del presente
Arrendamiento, y son responsables de acuerdo a dichos términos y condiciones.
Por contraprestación válida y onerosa, descripta más abajo, sirviendo el presente de suficiente recibo, el Arrendador y el
Arrendatario por el presente estipulan, convienen y acuerdan lo siguiente:
1.
OTORGAMIENTO DEL ARRENDAMIENTO: El
Arrendador por el presente cede en arrendamiento al
Arrendatario, y éste acepta, el inmueble ubicado en la
siguiente dirección y descrito a continuación, para destinarlo
exclusivamente para vivienda personal, excluyendo todo
otro tipo de uso:

2. NATURALEZA DE LA OCUPACIÓN DE LA
VIVIENDA: Como condición especial para el otorgamiento
del presente arrendamiento por parte del Arrendador al
Arrendatario, el Arrendatario se compromete a que la
vivienda descripta precedentemente sea usada y ocupada
únicamente por los miembros de la familia del Arrendatario
o por terceros cuyos nombres y edades se indican a
continuación:

3.
PLAZO DEL ARRENDAMIENTO: El presente
Arrendamiento comienza el ___ de ________ de 20____, y
vence el ___ de _______ de 20 ____, a menos que se
renueve o prorrogue de acuerdo con los plazos contenidos en
el presente.
4.
DEPÓSITO EN GARANTÍA: Al otorgarse el
presente Arrendamiento, el Arrendatario depositará la suma
de $ ________ que el Arrendador mantendrá como depósito
en garantía para destinar a la limpieza y a las reparaciones
razonables de los daños de la vivienda, una vez vencido el
presente Arrendamiento. El Arrendatario será responsable
ante el Arrendador de todos los daños sufridos en la vivienda
arrendada al producirse el vencimiento del presente
Arrendamiento, con excepción del desgaste natural
producido por el transcurso del tiempo. El Arrendatario [ ]
TIENE, [ ] NO TIENE, derecho a participación en el
depósito en garantía. El Arrendatario no podrá aplicar el
depósito en garantía a ninguna renta adeudada de acuerdo al
presente Arrendamiento. Si el Arrendador vende o cede la
vivienda arrendada, el Arrendador tendrá derecho a
transferir el depósito en garantía del Arrendatario al nuevo
propietario o cesionario para que éste lo retenga según el
presente Arrendamiento, y al hacerlo el Arrendador se
liberará de la responsabilidad de devolver dicho depósito en
garantía al Arrendatario.
Al producirse el vencimiento del presente Arrendamiento, el
depósito en garantía se aplicará a los daños de acuerdo con
las leyes aplicables del Estado de ____________.
5. PAGOS DEL PRECIO DEL ARRENDAMIENTO:
El Arrendatario acuerda pagar el precio del arrendamiento al
Arrendador durante el plazo del presente Arrendamiento en
cuotas mensuales iguales de $ ______; la cuota de cada mes
vencerá el primer día del mes o con anterioridad al primer
día del mes; el pago total del precio del arrendamiento según
el presente Arrendamiento vencerá el primer día del mes de
_______ de 20___.
El Arrendatario acuerda que si el precio del arrendamiento
no se pagara en su totalidad el ___ día del mes o con
anterioridad a dicha fecha, el Arrendatario pagará un recargo

El precio del arrendamiento prorrateado desde el comienzo

Arrendamiento y la ley aplicable se enviarán a la dirección
indicada más arriba.
El Arrendatario acuerda que el dinero del arrendamiento no
se considerará pagado hasta que el Arrendador o el agente
del Arrendador reciba el dinero del arrendamiento, ya sea
por correo o por entrega a la dirección indicada más arriba.
El envío del dinero del arrendamiento por correo por parte
del Arrendatario no es suficiente para considerar pagado el
precio del arrendamiento; por lo tanto el arrendamiento se
considerará impago hasta el momento del recibo del dinero.
En caso de haber múltiples Arrendatarios en el presente
Arrendamiento, dichos Arrendatarios estarán obligados
conjunta, separada e individualmente por los términos y
condiciones del presente Arrendamiento, y serán
responsables de acuerdo a dichos términos y condiciones.
La sentencia dictada contra un Arrendatario no impedirá el
inicio de acciones legales contra otros Arrendatarios.
6.
CONSECUENCIAS DEL INCUMPLIMIENTO
POR PARTE DEL ARRENDATARIO: Si el
Arrendatario, por acción u omisión, o por la acción u
omisión de cualquiera de los miembros de la familia o
invitados, personas autorizadas, y/o huéspedes del
Arrendatario, violara cualquiera de los términos o
condiciones del presente Arrendamiento o de cualquier otro
documento que formara parte del presente por referencia o
adjunto, el Arrendatario se considerará en incumplimiento
del presente Arrendamiento (el incumplimiento por parte de
un arrendatario se considerará incumplimiento por parte de
todos los arrendatarios cuando el Arrendatario sea más de
una persona).
En caso de dicho incumplimiento, el Arrendador podrá, a
opción del Arrendador, rescindir el presente Arrendamiento
mediante notificación escrita de terminación enviada al
Arrendatario, o mediante otros medios permitidos por la ley
aplicable. El Arrendatario acuerda expresamente desocupar
el inmueble y entregarlo al Arrendador al producirse el
vencimiento del periodo de notificación o con anterioridad al
mismo, independientemente de cualquier disputa que
pudiera existir respecto del incumplimiento del Arrendatario.
El Arrendatario acuerda y entiende expresamente que al
momento de la terminación del presente Arrendamiento por
parte del Arrendador, se producirá la ANULACIÓN DE
PLAZOS respecto del saldo total restante del precio del
arrendamiento impago correspondiente al plazo restante del
presente Arrendamiento, según la cual la suma total será
inmediatamente exigible y pagadera, exigiéndose su cobro.
El Arrendador podrá retener la porción restante del depósito
en garantía del Arrendatario después de la limpieza y las
reparaciones razonables en concepto de compensación
parcial por el pago adelantado del precio del arrendamiento.
7.
ENTREGA
DE NOTIFICACIONES:
El
Arrendatario enviará notificaciones de acuerdo con el
presente Arrendamiento o de la ley aplicable, por escrito, y
las entregará en la dirección indicada más arriba para el pago
del precio del arrendamiento, ya sea en mano o por correo.
Se recomienda el correo certificado o expreso. La entrega
por correo no se considerará completa hasta el momento del
efectivo recibo por parte del Arrendador o el agente del
Arrendador.
Las notificaciones del Arrendador al Arrendatario se
enviarán por escrito y se considerarán suficientemente
enviadas al Arrendatario cuando se depositen en el correo
dirigidas al inmueble arrendado, o dirigidas al último
domicilio postal conocido del Arrendatario, o entregadas por
mano, o colocadas en el buzón del Arrendatario. Si el
Arrendatario es más de una persona, la notificación a uno
será suficiente y se considerará una notificación a todos.
8.
SERVICIOS PÚBLICOS: El Arrendatario
suministrará y pagará los siguientes servicios públicos
(indicar lo que corresponda):

El Arrendador suministrará y pagará los siguientes servicios

El Arrendatario será responsable de contactar a los servicios
públicos no suministrados por el Arrendador, y no

suministro. El Arrendatario será responsable de hacer cortar
dichos servicios públicos para el día en que el Arrendatario
restituya
el inmueble al Arrendador al producirse la
terminación o vencimiento del presente Arrendamiento.
9.
NOTIFICACIÓN DE LA INTENCIÓN DE
DEVOLVER LA POSESIÓN DE LA UNIDAD
ARRENDADA Sin perjuicio de cualquier otra disposición
del presente Arrendamiento en contrario, al menos treinta
(30) días antes del vencimiento normal del plazo del
presente Arrendamiento como se indica más arriba bajo el
título PLAZO DEL ARRENDAMIENTO, el Arrendatario
enviará por escrito una notificación al Arrendador sobre la
intención del Arrendatario de devolver la posesión de la
unidad arrendada al producirse el vencimiento del plazo del
Arrendamiento. Si dicha notificación escrita no se envía en
el momento apropiado, el Arrendatario se convertirá en un
Arrendatario “mes a mes” como lo define la ley aplicable, y
todas las disposiciones del presente Arrendamiento se
mantendrán en vigencia, a menos que el presente
Arrendamiento se prorrogue o renueve por un plazo
específico mediante un acuerdo escrito del Arrendador y el
Arrendatario.
Si el Arrendatario se convierte en un arrendatario “mes a
mes”, el Arrendatario deberá enviar una notificación escrita
con treinta (30) días de anticipación al Arrendador sobre la
intención del Arrendatario de devolver la propiedad

la vivienda bajo la modalidad “mes a mes”, el Arrendador
podrá rescindir el Arrendamiento “mes a mes” enviando una
notificación escrita de terminación al Arrendatario, o
mediante otros medios permitidos por la ley aplicable. Al
producirse la terminación, el Arrendatario desocupará el
inmueble y entregará el mismo al Arrendador al producirse
el vencimiento del periodo de notificación o con anterioridad
al mismo.

10.
OBLIGACIONES
ARRENDADOR:
(h) No realizará en el inmueble arrendado actividades ilícitas
contempladas por organismos a cargo de la aplicación de la
ley.

El Arrendador:
(g) Mantendrá la unidad de vivienda esencialmente en las
mismas condiciones, con excepción del desgaste normal
producido por el transcurso del tiempo, y cumplirá los
requisitos de los códigos aplicables de construcción y
viviendas que afecten sustancialmente la salud y la
seguridad.
(a) Cumplirá de buena fe con los términos y condiciones del
presente Arrendamiento y con la ley aplicable.
(i) Pagará los gastos de reemplazo de llaves perdidas o daños
relacionados con la propiedad, y devolverá dichas llaves al
Arrendador al producirse el vencimiento o la terminación del
presente Arrendamiento.
(b) Cumplirá con los requisitos de los códigos aplicables de
construcción y viviendas que afecten sustancialmente la
salud y la seguridad.
(j) No tendrá mascotas de ningún tipo ni en el inmueble
arrendado ni en las áreas comunes, excepto ____________.
(c) Mantendrá la unidad de vivienda, su instalación sanitaria,
sistemas de calefacción y/o enfriamiento sustancialmente en
las mismas condiciones en que se encontraban al iniciarse el
arrendamiento, con excepción del desgaste normal por el
transcurso del tiempo, a menos que la unidad de vivienda,
sus cañerías, sistemas de calefacción y/o enfriamiento
estuvieran dañados o afectados como resultado de acciones
deliberadas o negligentes del arrendatario o de personas que
estuvieran presentes en la unidad a sabiendas del
Arrendatario o con su permiso.
(d) Pagará los impuestos inmobiliarios correspondientes al
inmueble arrendado.
11.
OBLIGACIONES
ARRENDATARIO:

DEBERES
DEL
El Arrendatario:
(a) Cumplirá de buena fe con los términos y condiciones del
presente Arrendamiento y con la ley aplicable.
(b) Mantendrá el inmueble en las condiciones de limpieza y
seguridad que el inmueble permita.
(c) Utilizará en forma razonable las instalaciones del
inmueble, a saber, eléctricas, cañerías, sanitarias, de
calefacción, de ventilación, de aire acondicionado y otras
instalaciones y artefactos, incluso los ascensores.
(d) No destruirá, ensuciará, dañará, afectará ni eliminará en
forma deliberada o negligente ninguna parte del inmueble, ni
permitirá la acción deliberada o negligente de terceros a este
respecto.
(e) Se comportará de manera tal que no se perturbe el goce
pacífico de los vecinos del inmueble, y exigirá a aquellos
presentes en el inmueble que se comporten de igual modo.
(f) Informará al Arrendador sobre cualquier situación que
pudiera causar daño al inmueble, de la que el Arrendatario

disposiciones se considerará incumplimiento del presente
Arrendamiento.
12.
NO HABRÁ CESIÓN: El Arrendatario acuerda
expresamente que no cederá ni subarrendará el inmueble
arrendado ni parte del mismo sin el previo consentimiento
escrito del Arrendador.
13. SEGURO DEL ARRENDATARIO: El Arrendador no
será responsable ante el Arrendatario, la familia del
Arrendatario ni los invitados, las personas autorizadas, y/o
los huéspedes del Arrendatario por daños no causados
directamente por el Arrendador o por los agentes del
Arrendador. El Arrendador no compensará al Arrendatario
ni a ninguna otra persona por daños causados directamente
por cualquier otro origen, o por casos fortuitos, y por lo tanto
se recomienda enfáticamente al Arrendatario tomar
independientemente un seguro para proteger al Arrendatario,
la familia del Arrendatario, los invitados, las personas
autorizadas, y/o los huéspedes del Arrendatario, y todos los
bienes muebles colocados en el inmueble arrendado y en las
áreas comunes, contra daños de todo tipo.
14. CONDICIÓN DEL INMUEBLE ARRENDADO: El
Arrendatario por el presente declara que ha revisado el
inmueble arrendado con anterioridad a la firma del presente
Arrendamiento, o bien que ha renunciado a dicha revisión a
sabiendas. El Arrendatario declara que el Arrendatario no se
ha basado en declaraciones efectuadas por el Arrendador ni
por agentes del Arrendador respecto del estado del inmueble
arrendado y que el Arrendatario acepta el inmueble en el
estado en que se encuentra sin garantías ni declaraciones
expresas o implícitas más allá de las contenidas en el
presente o requeridas por la ley aplicable. El Arrendatario
acuerda no dañar el inmueble mediante acción u omisión de
cualquier naturaleza, y ser responsable por los daños
sufridos a causa de actos u omisiones del Arrendatario, la
familia del Arrendatario, los invitados, las personas

autorizadas y/o los huéspedes del Arrendatario. Si se
incurriera en dichos daños, se exigirá al Arrendatario el pago
de las reparaciones surgidas consecuentemente, el cual
deberá efectuar en el momento del pago del precio del
arrendamiento del próximo mes como un adicional a dicha
renta; la falta de dicho pago tendrá consecuencias idénticas a
las estipuladas por la falta de pago del arrendamiento
descrito en el presente. Al producirse el vencimiento o la
terminación del Arrendamiento, el Arrendatario devolverá el
inmueble arrendado en el mismo estado de conservación que
tenía el inmueble cuando el Arrendatario lo aceptó al
comienzo del arrendamiento, con excepción del desgaste
normal producido por el transcurso del tiempo. El
Arrendatario tendrá derecho a retirar del inmueble los
aparatos y accesorios del Arrendatario colocados en el
mismo por el Arrendatario a su cargo, siempre que el
Arrendatario al retirarlos restaure el inmueble arrendado de
modo que éste quede en el mismo estado que tenía antes de
colocarse dichos aparatos y accesorios, es decir, bueno,
seguro, sólido, ordenado y de buen aspecto. En su defecto,
el Arrendatario estará obligado a pagar las reparaciones
estipuladas más arriba.
15.
ALTERACIONES: El Arrendatario no hará
alteraciones o cambios en el inmueble arrendado, ni
efectuará decoraciones, agregados o mejoras en el mismo,
sin obtener el previo consentimiento expreso por escrito del
Arrendador. Cualquiera de los trabajos descritos
precedentemente se convertirá en parte de la vivienda. Si
fueran realizados por contratistas independientes, dichos
contratistas deberán ser aprobados por el Arrendador. El
Arrendatario no contratará obras sin depositar previamente
dinero suficiente para cubrir el precio del contrato en una
cuenta de depósito aprobada por el Arrendador. Todas las
obras se realizarán en los momentos y en la forma que
determine el Arrendador. Si se coloca un mechanic’s lien
(N. de T. 1) sobre el inmueble arrendado como consecuencia
de las obras, el Arrendatario exclusivamente se hará cargo
del pago del mismo dentro de los diez días posteriores. La
falta de pago de dicho lien (N. de T. 1) por parte del
Arrendatario se considerará incumplimiento del presente
Arrendamiento.
16.
NO SE PERMITIRÁ EL USO ILEGAL: El
Arrendatario no cometerá, permitirá ni tolerará actos u
omisiones contrarios a la ley o a ordenanzas en el inmueble
arrendado o en las áreas comunes. El Arrendatario acuerda
informar de inmediato al Arrendador y a las autoridades
correspondientes en caso de tomar conocimiento efectivo de
actos u omisiones ilegales llevados a cabo en el inmueble
arrendado. El Arrendatario será responsable de los actos u
omisiones ilegales producidos en el inmueble arrendado y se
considerará en incumplimiento del presente Arrendamiento
en caso de condena del Arrendatario o de cualquiera de los
miembros de la familia o invitados, personas autorizadas,
y/o huéspedes del Arrendatario, por actos u omisiones
ilegales producidos en el inmueble arrendado, con o sin
conocimiento del Arrendatario.
17.
NOTIFICACIÓN DE LESIONES: En el caso de
lesiones importantes causadas al Arrendatario, los miembros
de la familia del Arrendatario, los invitados, las personas
autorizadas y/o los huéspedes del Arrendatario, o daños
causados en los bienes muebles, sufridos en el inmueble
arrendado o en las áreas comunes, el Arrendatario enviará
una notificación escrita de los mismos al Arrendador a la
dirección designada para entrega de notificaciones (idéntica
a la dirección de pago del precio del arrendamiento) tan
pronto como sea posible pero con un máximo de cinco (5)
días después de producirse dichas lesiones o daños. La falta
de envío de dicha notificación constituirá incumplimiento
del presente Arrendamiento.
18.
DERECHO
A
HIPOTECA
DEL
ARRENDADOR: El Arrendatario acepta el inmueble sujeto
y subordinado a cualquier hipoteca o privilegio existente o
futuro, y el Arrendador se reserva el derecho a someter el
inmueble a los mismos. El Arrendatario acuerda y por el
presente otorga en forma irrevocable al Arrendador poder
para el Arrendatario con el único propósito de otorgar y
entregar en nombre del Arrendatario cualquier documento o
documentos relacionados con el derecho del Arrendador a
someter el inmueble a hipoteca u otro privilegio.
19.
DEMORA EN LAS REPARACIONES: El
Arrendatario acuerda que en el caso de demora en las
reparaciones a cargo del Arrendador por razones ajenas a la
voluntad del Arrendador, esto no producirá efectos en las
obligaciones del Arrendatario de acuerdo con el presente
Arrendamiento.
20.
ABANDONO: Se define como abandono a la
ausencia del Arrendatario del inmueble arrendado por un
periodo de siete (7) o más días consecutivos mientras esté
pendiente de pago el arrendamiento u otras deudas, situación
por la cual el Arrendatario se considerará en incumplimiento
del presente Arrendamiento. Esta definición está
subordinada a los derechos y recursos del Arrendador de
acuerdo con el presente Arrendamiento y de la ley aplicable,
y no afectará a los mismos de ninguna manera, excepto que
en caso de abandono, el Arrendador o los agentes del
Arrendador podrán de inmediato o en cualquier momento a
partir de entonces entrar en el inmueble arrendado y tomar la
posesión del mismo según establece la ley aplicable, y
rescindir el presente Arrendamiento sin notificación al
Arrendatario.
21. NOTIFICACIÓN DE AUSENCIA DEL INMUEBLE
ARRENDADO: En caso de que el Arrendatario deba
ausentarse del inmueble arrendado por siete (7) o más días
consecutivos, deberá enviar notificación escrita al
Arrendador. Si dichas ausencias se tornaran habituales o
frecuentes, se deberá indicar sumariamente a continuación la
frecuencia y duración esperadas de dichas ausencias:

El Arrendatario acuerda y entiende expresamente que la
ausencia del inmueble, con o sin notificación, de ninguna
manera evita el requisito de pago del precio del
arrendamiento y de otras deudas como se establece en el
presente, ni las consecuencias surgidas de la falta de pago de
los mismos en el momento oportuno.
22. POSESIÓN DEL INMUEBLE: El Arrendatario no
tendrá derecho a la posesión del inmueble designado para
arrendamiento hasta que se pague en su totalidad el depósito
en garantía y el precio del arrendamiento correspondiente al
primer mes (o una parte prorrateada del mismo), menos
algún descuento promocional aplicable, y hasta que el
arrendatario anterior haya desocupado el inmueble
designado para arrendamiento.
23. DEMORA DE LA POSESIÓN: El Arrendatario
acuerda expresamente que si el Arrendatario no pudiera
entrar al inmueble y ocuparlo porque el mismo no estuviera
listo para ser ocupado, o porque el arrendatario u ocupante
anterior permaneciera en la vivienda por más tiempo, o por
otra causa de cualquier naturaleza, el Arrendador no será
responsable ante el Arrendatario por daños, pero deducirá
del precio del arrendamiento el periodo en el cual el
Arrendatario no pudiera ocupar el inmueble.
24.
PERTINENCIA DE LA SOLICITUD DE
ARRENDAMIENTO: Todas las declaraciones efectuadas
por el/los Arrendatario(s) en la Solicitud de Arrendamiento
(o documento con título similar) son pertinentes al
otorgamiento del presente Arrendamiento, y el
Arrendamiento se otorga solamente a condición de la
veracidad y exactitud de dichas declaraciones.
El
Arrendador puede considerar al Arrendatario en
incumplimiento del presente Arrendamiento si no se provee
información relevante en la Solicitud o en caso de no
veracidad de la información consignada en la misma.
25.
MODIFICACIÓN
DEL
PRESENTE
ARRENDAMIENTO: Las modificaciones del presente
Arrendamiento no serán vinculantes para el Arrendador a
menos que se efectúen por escrito y estén firmadas por el
Arrendador o por un agente autorizado del Arrendador. Las
declaraciones verbales no tendrán efecto modificatorio en el
presente Arrendamiento. Si, de acuerdo con los términos del
presente párrafo, se agregara, modificara o eliminara
cualquier disposición de este arrendamiento, el resto del
presente Arrendamiento se mantendrá en plena vigencia y
efecto.
26. RECURSOS NO EXCLUSIVOS: Los recursos y
derechos contenidos en el presente Arrendamiento y
transmitidos por el mismo son acumulativos, y no exclusivos
de otros derechos y beneficios permitidos por la ley
aplicable.
27.
DIVISIBILIDAD: Si cualquier disposición
contenida en el presente, o parte de la misma, se tornara
inválida por ley o por sentencia o mandamiento judicial, las
disposiciones restantes y/o partes de las disposiciones
continuarán en plena vigencia y efecto y se interpretará que
se mantendrán de ese modo.
28.
NO RENUNCIA: La falta de insistencia por parte
del Arrendador sobre el estricto cumplimiento de los plazos,
las disposiciones contractuales y acuerdos contenidos en el
presente no se interpretará como renuncia al derecho del
Arrendador a hacer aplicar de allí en más dichos plazos,
estipulaciones o condiciones, sino que los mismos se
mantendrán en plena vigencia y efecto. Ningún acto u
omisión del Arrendador se considerará renuncia al
cumplimiento de ninguno de los términos y condiciones del
presente Arrendamiento, ni tampoco se considerará como un
pretexto para algún comportamiento contrario a los términos
y condiciones del presente Arrendamiento, ni se considerará
de modo tal que constituya un patrón de conducta entre
Arrendador y Arrendatario sobre el que pueda basarse el
Arrendatario, si dicho acto u omisión fuera contrario a los
términos y condiciones del presente Arrendamiento.
29.
HONORARIOS DE ABOGADOS: En el caso de
que el Arrendador emplee un abogado para cobrar el precio
del arrendamiento u otros cargos adeudados de acuerdo con
el presente por el Arrendatario o para hacer cumplir al
Arrendatario cualquiera de las estipulaciones contenidas en
el presente o para proteger los intereses del Arrendador de
acuerdo con el presente, el Arrendatario acuerda pagar un
honorario de abogado razonable y todos los gastos y costos
relacionados en los que se incurran.
30.
HEREDEROS Y CESIONARIOS: Se acuerda y
entiende que todas las disposiciones contractuales del
presente arrendamiento se transmitirán a los respectivos
herederos, albaceas testamentarios, administradores,
sucesores y, con excepción de lo estipulado en el presente,
cesionarios de las partes del presente, y serán vinculantes
para los mismos, pero ninguna disposición del presente se
interpretará de modo tal que permita al Arrendatario
transferir o ceder este arrendamiento violando términos y
condiciones del presente.
31.
DESTRUCCIÓN DEL INMUEBLE: En caso de
destrucción o daño total del inmueble arrendado por
incendio, huracán o cualquier otra causa ajena a la voluntad
del Arrendador, el presente Arrendamiento se extinguirá y
vencerá a la fecha de dicha destrucción, y el precio del
arrendamiento se calculará entonces entre el Arrendador y
el Arrendatario hasta el momento en que dicho daño o
destrucción de dicho inmueble sea el mismo que el que se
prorratee a esa fecha. En caso de daño al inmueble
arrendado por incendio, huracán o cualquier otra causa ajena
a la voluntad del Arrendador, lo cual deteriore parcialmente
el inmueble pudiendo repararse dentro de un plazo
razonable, este Arrendamiento se mantendrá en plena
vigencia y efecto y el Arrendador, dentro de un plazo
razonable,
restaurará
dicho
inmueble
dejándolo
sustancialmente en las mismas condiciones en que estaba
antes de dicho daño, y se efectuará una rebaja del precio del

arrendamiento proporcional a la relación que mantiene la
porción dañada del inmueble arrendado con la totalidad de
dicho inmueble.
32.
DOMINIO EMINENTE: En caso de que el
inmueble arrendado sea tomado por dominio eminente, el
precio del arrendamiento se prorrateará a la fecha de
posesión y este Arrendamiento vencerá a esa fecha.
33.
INGRESO Y DERECHO DE RETENCIÓN
DEL ARRENDADOR: Además de los derechos otorgados
por la ley aplicable, el Arrendador tendrá derecho a ingresar
al inmueble arrendado en cualquier momento razonable con
el propósito de inspeccionar el mismo y/o mostrar el mismo
a futuros arrendatarios o compradores, y hacer las
reparaciones y cambios razonables que considere necesarios
para la preservación del inmueble arrendado o el edificio y
eliminar cambios, agregados, artefactos, y cualquier otro
objeto que pudiera fijarse o construirse violando los
términos y condiciones del presente Arrendamiento. Por otra
parte, el Arrendador tiene el Derecho de Retención del
Arrendador sobre todos los bienes muebles colocados en el
inmueble para asegurar el pago del precio del arrendamiento
y de cualquier daño al inmueble arrendado.
34.
LEY APLICABLE: El presente Arrendamiento se
rige por la ley escrita y la jurisprudencia del estado en el

NOTAS SOBRE REQUISITOS DE DECLARACIÓN DE INFORMACIÓN
SOBRE PINTURA CON PLOMO
Introducción: Si la unidad de vivienda para arrendamiento se construyó CON ANTERIORIDAD a 1978, la ley
federal EXIGE que se adjunte al contrato de arrendamiento un Formulario de Declaración de Información sobre
Pintura con Plomo, completado y firmado por el locador/arrendador y locatario/arrendatario. Si la unidad de
vivienda para arrendamiento se construyó en 1978 o con posterioridad, no se exige dicho formulario. En caso de
duda sobre la fecha de construcción, utilice el formulario de declaración de información. Cada vez que se utiliza
el formulario, el arrendador debe entregar al arrendatario también un panfleto de la EPA sobre pintura con
plomo mencionado más abajo. Los arrendadores deben retener una copia del formulario de declaración de
información firmado por un periodo no inferior a tres años contados desde la fecha de comienzo del
arrendamiento.
Antecedentes: Para proteger a las familias de la exposición al plomo proveniente de la pintura, el polvo, y el
suelo, el Congreso aprobó la Ley de Reducción de Peligros de la Pintura con Plomo en Viviendas (“Residential
Lead-Based Paint Hazard Reduction Act”) de 1992. El Departamento de Viviendas y Urbanización (HUD) y la
Agencia de Protección Ambiental (EPA) exigen la declaración de información conocida, sobre pintura con
plomo y peligros relacionados antes de arrendar la mayoría de las viviendas construidas con anterioridad a
1978.
Requisitos: Antes de firmar y acordar el arrendamiento, los arrendadores deben cumplir en su totalidad con la
ley de declaración de información sobre pintura con plomo. Dicho cumplimiento se perfecciona de la siguiente
manera:
(1) Completar en su totalidad y entregar a los arrendatarios, como adjunto al contrato de arrendamiento, el
formulario de DECLARACIÓN DE INFORMACIÓN SORE PINTURA CON PLOMO, (el
arrendador/arrendatario también deberá escribir sus iniciales y firmar este formulario), y
(2) Entregar a los arrendatarios el panfleto de la EPA titulado “Proteja a su familia del plomo en su hogar”.

RESIDENTIAL LEASE AGREEMENT
This Residential Lease Agreement (hereinafter “Lease”) is entered into this ____ day of _____________, 20____, by and

6.
CONSEQUENCES OF BREACH BY TENANT:
If Tenant, by any act or omission, or by the act or omission
of any of Tenant’s family or invitees, licensees, and/or
guests, violates any of the terms or conditions of this Lease
or any other documents made a part hereof by reference or
attachment, Tenant shall be considered in breach of this
Lease (breach by one tenant shall be considered breach by
all tenants where Tenant is more than one person).
In case of such breach, Landlord may, at Landlord’s option,
terminate this Lease by written notice of termination to
Tenant, or by any other means allowed by applicable law.
Tenant expressly agrees to vacate the premises and deliver
same unto Landlord on or before the expiration of the period
of notice, regardless of any dispute that may exist regarding
Tenant’s breach.
Tenant expressly agrees and understands that upon
Landlord’s termination of this Lease, the entire remaining
balance of unpaid rent for the remaining term of this Lease
shall ACCELERATE, whereby the entire sum shall become
immediately due, payable, and collectable. Landlord may
hold the portion of Tenant’s security deposit remaining after
reasonable cleaning and repairs as a partial offset to
satisfaction of the accelerated rent.
7.
DELIVERY OF NOTICES: Any giving of notice
under this Lease or applicable law shall be made by Tenant
in writing and delivered to the address noted above for the
payment of rent, either by hand delivery or by mail.
Certified or registered mail is recommended. Delivery by
mail shall not be considered complete until actual receipt by
Landlord or Landlord’s agent.
Any notices from Landlord to Tenant shall be in writing and
shall be deemed sufficiently served upon Tenant if when
deposited in the mail addressed to the leased premises, or
addressed to Tenant’s last known post office address, or
hand delivered, or placed in Tenant’s mailbox. If Tenant is
more than one person, then notice to one shall be sufficient
as notice to all.
8.
UTILITIES: Tenant will provide and pay for the
following utilities (indicate those that apply):

least thirty (30) days prior to the normal expiration of the
term of this Lease as noted under the heading TERM OF
LEASE above, Tenant shall give written notice to Landlord
of Tenant’s intention to surrender the residence at the
expiration of the Lease term. If said written notice is not
timely given, the Tenant shall become a month-to-month
tenant as defined by applicable law, and all provisions of this
Lease will remain in full force and effect, unless this Lease
is extended or renewed for a specific term by written
agreement of Landlord and Tenant.
If Tenant becomes a month-to-month tenant in the manner
described above, Tenant must give a thirty (30) day written
notice to the Landlord of Tenant’s intention to surrender the
residence. At any time during a month-to-month tenancy
Landlord may terminate the month-to-month Lease by
serving Tenant with a written notice of termination, or by
any other means allowed by applicable law.
Upon
termination, Tenant shall vacate the premises and deliver
same unto Landlord on or before the expiration of the period
of notice.
10. OBLIGATIONS AND DUTIES OF LANDLORD:
Landlord shall:
(a) Comply in good faith with all terms and conditions of
this Lease, and with all applicable law.
(b) Comply with the requirements of applicable building and
housing codes materially affecting health and safety.
(c) Maintain the dwelling unit, its plumbing, heating and/or
cooling system, in substantially the same condition as at the
inception of the lease, reasonable wear and tear excluded,
unless the dwelling unit, its plumbing, heating and/or
cooling system is damaged or impaired as a result of the
deliberate or negligent actions of the tenant or those present
with Tenant’s knowledge or permission.
(d) Pay real estate taxes on the leased premises.
Landlord will provide and pay for the following utilities
(indicate those that apply):

(b) Keep the premises as clean and as safe as the condition
of the premises permits.
(c) Use in a reasonable manner all electrical, plumbing,
sanitary, heating, ventilating, air conditioning and other
facilities and appliances, including elevators, in the
premises.
(d) Not deliberately or negligently destroy, deface, damage,
impair or remove any part of the premises or permit any
other person to do so.
(e) Conduct himself/herself and require other persons on the
premises to conduct themselves in a manner that will not
disturb any neighbors' peaceful enjoyment of neighboring
premises.
(f) Inform Landlord of any condition of which Tenant has
knowledge which may cause damage to the premises.
(g) Maintain the dwelling unit in substantially the same
condition, reasonable wear and tear excepted, and comply
with the requirements of applicable building and housing
codes materially affecting health and safety.
(h) Not engage in any illegal activity upon the leased
premises as documented by a law enforcement agency.
(i) Pay the expenses for replacing all keys related to the
premises that are lost or damaged, and shall return said keys
to Landlord at the expiration or termination of this Lease.

12.
NO ASSIGNMENT: Tenant expressly agrees that

13. TENANT INSURANCE: Landlord shall not be liable
to Tenant, Tenant’s family or Tenant’s invitees, licensees,
and/or guests for damages not proximately caused by
Landlord or Landlord’s agents.
Landlord will not
compensate Tenant or anyone else for damages proximately
caused by any other source whatsoever, or by Acts of God,
and Tenant is therefore strongly encouraged to
independently purchase insurance to protect Tenant,
Tenant’s family, Tenant’s invitees, licensees, and/or guests,
and all personal property on the leased premises and any
common areas from any and all damages.
14.
CONDITION OF LEASED PREMISES:
hereby acknowledges that Tenant has examined the leased
premises prior to the signing of this Lease, or knowingly
waived said examination. Tenant acknowledges that Tenant
has not relied on any representations made by Landlord or
Landlord’s agents regarding the condition of the leased
premises and that Tenant takes premises in its AS-IS
condition with no express or implied warranties or
representations beyond those contained herein or required by
applicable law. Tenant agrees not to damage the premises
through any act or omission, and to be responsible for any
damages sustained through the acts or omissions of Tenant,
Tenant’s family or Tenant’s invitees, licensees, and/or
guests. If such damages are incurred, Tenant is required to
pay for any resulting repairs at the same time and in addition
to the next month’s rent payment, with consequences for
non-payment identical to those for non-payment of rent
described herein. At the expiration or termination of the
Lease, Tenant shall return the leased premises in as good
condition as when taken by Tenant at the commencement of
the lease, with only normal wear-and-tear excepted. Tenant
shall have the right to remove from the premises Tenant’s
fixtures placed thereon by Tenant at his expense, provided,
however, that Tenant in effecting removal, shall restore the
leased premises to as good, safe, sound, orderly and sightly
condition as before the addition of Tenant’s fixture. Failing
this, Tenant shall be obligated to pay for repairs as stated
above.
15. ALTERATIONS: Tenant shall make no alterations,
decorations, additions, or improvements to the leased
premises without first obtaining the express written consent
of Landlord. Any of the above-described work shall become
part of the dwelling. If carried out by independent
contractors, said contractors must be approved by Landlord.
Tenant shall not contract for work to be done without first
placing monies sufficient to satisfy contract price in escrow
account approved by Landlord. All work shall be done at
such times and in such manner as Landlord may designate.
If a construction or mechanic’s lien is placed on the leased
premises as a result of the work, such shall be satisfied by
Tenant within ten (10) days thereafter at Tenant’s sole
expense. Tenant shall be considered in breach of this Lease
upon failure to satisfy said lien.

NO ILLEGAL USE: Tenant shall not perpetrate,
allow or suffer any acts or omissions contrary to law or
ordinance to be carried on upon the leased premises or in
any common area. Upon obtaining actual knowledge of any
illegal acts or omissions upon the leased premises, Tenant
agrees to immediately inform Landlord and the appropriate
authorities. Tenant shall bear responsibility for any and all
illegal acts or omissions upon the leased premises and shall
be considered in breach of this Lease upon conviction of
Tenant or any of Tenant’s family or invitees, licensees,
and/or guests for any illegal act or omission upon the leased
premises- whether known or unknown to Tenant.

17.
NOTICE OF INJURIES: In the even of any
significant injury or damage to Tenant, Tenant’s family, or
Tenant’s invitees, licensees, and/or guests, or any personal
property, suffered in the leased premises or in any common
area, written notice of same shall be provided by Tenant to
Landlord at the address designated for delivery of notices
(identical to address for payment of rent) as soon as possible
but not later than five (5) days of said injury or damage.
Failure to provide such notice shall constitute a breach of
this Lease.
18.
LANDLORD’S RIGHT TO MORTGAGE:
Tenant agrees to accept the premises subject to and
subordinate to any existing or future mortgage or other lien,
and Landlord reserves the right to subject premises to same.
Tenant agrees to and hereby irrevocably grants Landlord
power of attorney for Tenant for the sole purpose of
executing and delivering in the name of the Tenant any
document(s) related to the Landlord’s right to subject the
premises to a mortgage or other lien.
19.
DELAY IN REPAIRS: Tenant agrees that if any
repairs to be made by Landlord are delayed by reasons
beyond Landlords control, there shall be no effect on the
obligations of Tenant under this Lease.
20.
ABANDONMENT:
Abandonment shall be
defined as the absence of the Tenant from the leased
premises for a period of seven (7) or more consecutive days
while rent or any owing monies remain unpaid- whereupon
Tenant will be considered in breach of this Lease. This
definition is subordinate to, and shall not in any way impair,
the rights and remedies of Landlord under this Lease or
applicable law, except that in case of abandonment,
Landlord or Landlord’s agents may immediately or any time
thereafter enter and re-take the leased premises as provided
by applicable law, and terminate this Lease without notice to
Tenant.
21. NOTICE OF ABSENCE FROM PREMISES: If
Tenant is to be absent from the leased premises for seven (7)
or more consecutive days, written notice of such should be
served upon Landlord. If such absences are to be customary
or frequent, the expected frequency and duration of absence
should

Tenant expressly agrees and understands that absence from
the premises, with or without notice, in no way obviates the
requirement to pay rent and other monies as stated herein, or
the consequences of failure to timely pay same.
22. POSSESSION OF PREMISES: Tenant shall not be
entitled to possession of the premises designated for lease
until the security deposit and first month’s rent (or prorated
portion thereof), less any applicable promotional discount, is
paid in full and the premises designated for lease is vacated
by the prior tenant.
23. DELAY OF POSSESSION: Tenant expressly agrees
that if by reason of the premises being unready for
occupancy, or by reason of the previous tenant or occupant
of the dwelling holding over, or as a result of any other
cause whatsoever, Tenant is unable to enter and occupy the
premises, Landlord shall not be liable to Tenant in damages,
but shall abate the rent for the period in which the Tenant is
unable to occupy the premises.
24. MATERIALITY OF APPLICATION TO RENT:
All representations made by Tenant(s) on the Application to
Rent (or like-titled document) are material to the grant of
this Lease, and the Lease is granted only on condition of the
truthfulness and accuracy of said representations. If a failure
to disclose or lack of truthfulness is discovered on said
Application, Landlord may deem Tenant to be in breach of
this Lease.
25.
MODIFICATION OF THIS LEASE: Any
modification of this lease shall not be binding upon Landlord
unless in writing and signed by Landlord or Landlord’s
authorized agent. No oral representation shall be effective to
modify this Lease. If, as per the terms of this paragraph, any
provision of this lease is newly added, modified, or stricken
out, the remainder of this Lease shall remain in full force
and effect.
26. REMEDIES NOT EXCLUSIVE: The remedies and
rights contained in and conveyed by this Lease are
cumulative, and are not exclusive of other rights, remedies
and benefits allowed by applicable law.
27.
SEVERABILITY: If any provision herein, or any
portion thereof, is rendered invalid by operation of law,
judgment, or court order, the remaining provisions and/or
portions of provisions shall remain valid and enforceable
and shall be construed to so remain.
28.
NO WAIVER: The failure of Landlord to insist
upon the strict performance of the terms, covenants, and
agreements herein shall not be construed as a waiver or
relinquishment of Landlord's right thereafter to enforce any
such term, covenant, or condition but the same shall
continue in full force and effect. No act or omission of
Landlord shall be considered a waiver of any of the terms or
conditions of this Lease, nor excuse any conduct contrary to
the terms and conditions of this Lease, nor be considered to
create a pattern of conduct between the Landlord and Tenant
upon which Tenant may rely upon if contrary to the terms
and conditions of this Lease.
29.
ATTORNEY FEES: In the event that Landlord
employees an attorney to collect any rents or other charges
due hereunder by Tenant or to enforce any of Tenant's

covenants herein or to protect the interest of the Landlord
hereunder, Tenant agrees to pay a reasonable attorney's fee
and all expenses and costs incurred thereby.
30.
HEIRS AND ASSIGNS:
It is agreed and
understood that all covenants of this lease shall succeed to
and be binding upon the respective heirs, executors,
administrators, successors and, except as provided herein,
assigns of the parties hereto, but nothing contained herein
shall be construed so as to allow the Tenant to transfer or
assign this lease in violation of any term hereof.
DUST CAN POSE HEALTH HAZARDS IF NOT
MANAGED PROPERLY. LEAD EXPOSURE IS
ESPECIALLY HARMFUL TO YOUNG CHILDREN
AND PREGNANT WOMEN. BEFORE RENTING
PRE-1978 HOUSING, LESSORS MUST DISCLOSE
THE PRESENCE OF KNOWN LEAD-BASED PAINT
AND/OR LEAD-BASED PAINT HAZARDS IN THE
DWELLING. LEASES MUST ALSO RECEIVED A
FEDERALLY APPROVED PAMPHLET ON LEAD
POISONING PREVENTION.

31.
DESTRUCTION OF PREMISES: In the event
the leased premises shall be destroyed or rendered totally
untenable by fire, windstorm, or any other cause beyond the
control of Landlord, then this Lease shall cease and
terminate as of the date of such destruction, and the rent
shall then be accounted for between Landlord and Tenant up
to the time of such damage or destruction of said premises is
the same as being prorated as of that date. In the event the
leased premises are damaged by fire, windstorm or other
cause beyond the control of Landlord so as to render the
same partially untenable, but repairable within a reasonable
time, then this lease shall remain in force and effect and the
Landlord shall, within said reasonable time, restore said
premises to substantially the condition the same were in
prior to said damage, and there shall be an abatement in rent
in proportion to the relationship the damaged portion of the
leased premises bears to the whole of said premises.
32.
EMINENT DOMAIN: In the event that the leased
premises shall be taken by eminent domain, the rent shall be
prorated to the date of taking and this Lease shall terminate
on that date.
37.
LANDLORD ENTRY AND LIEN: In addition to
the rights provided by applicable law, Landlord shall have
the right to enter the leased premises at all reasonable times
for the purpose of inspecting the same and/or showing the
same to prospective tenants or purchasers, and to make such
reasonable repairs and alterations as may be deemed
necessary by Landlord for the preservation of the leased
premised or the building and to remove any alterations,
additions, fixtures, and any other objects which may be
affixed or erected in violation of the terms of this Lease.
Furthermore, Landlord retains a Landlord’s Lien on all
personal property placed upon the premises to secure the
payment of rent and any damages to the leases premises.
The leased premises was constructed in 1978 or later.
The leased premises was constructed prior to 1978.
Landlord has conformed with all federal requirements
regarding lead-based paint disclosure including the
completion and mutual signing with Tenant and any agents,
of the Lead-Based Paint Disclosure Form attached hereto
and incorporated into this lease as a part hereof. All
associated information required by the Disclosure form (if
any) was furnished to Tenant, and Tenant received the EPA
pamphlet “Protect Your Family from Lead in Your Home.”

NOTES CONCERNING LEAD-PAINT DISCLOSURE REQUIREMENTS
Introduction: If the rental dwelling unit was constructed PRIOR TO 1978, federal law REQUIRES a LeadBased Paint Disclosure Form to be attached to the lease, completed and signed by the lessor/landlord and
lessee/tenant. If the rental dwelling was constructed in 1978 or later, this form is not required. If in doubt about
the timing of construction, use the disclosure form. Whenever the form is used, the landlord must also give the
tenant the EPA lead-based paint pamphlet discussed below. Landlords must retain a copy of the signed
disclosure form for no less than three years from the date the lease begins.
Background: To protect families from exposure to lead from paint, dust, and soil, Congress passed the
Residential Lead-Based Paint Hazard Reduction Act of 1992. HUD and EPA require the disclosure of known
information on lead-based paint and related hazards before the lease of most housing built before 1978.
Requirements: Before the lease is signed and agreed to, landlords must fully comply with lead-paint disclosure
law. Compliance is accomplished by:
(1) Fully completing and delivering to the tenants, as an attachment to the lease, the LEAD-BASED PAINT
DISCLOSURE form (the lessees/renters also initial and sign this form), and
(2) Giving the tenants the EPA pamphlet entitled "Protect Your Family From Lead In Your Home." (See the
download link for the pamphlet, below.)
