U List of Clauses Unborn Issue; Disposition of Frozen Sperm, Ovum and/or Embryo Unborn Issue; Disposition of Pre-Zygotes Unborn Issue; Frozen Sperm Cells to Remain Active Unborn Issue; Ordered Destruction of Frozen Sperm Stem Cells U Text of Clauses Unborn Issue; Disposition of Frozen Sperm, Ovum and/or EmbryoThe parties acknowledge that during their marriage they have placed into storage in a medical genetic bank (the "Bank") maintained and operated by (name of hospital and/or institution) sperm, ovum, and/or embryo to insure that they could have children in the future. The sperm, ovum and/or embryo are currently held in a frozen state. The parties agree that based upon their marital difficulties the sperm, ovum and/or embryo shall remain inactive and frozen unless the parties shall mutually agree to how the sperm, ovum and/or embryo shall be disposed. The parties further agree that neither party may unilaterally instruct the Bank to withdraw, inseminate, implant or use the sperm, ovum and/or embryo in any manner except upon mutual agreement of the parties in writing. The parties agree that they shall pay all reasonable fees imposed by the Bank's fees to maintain the sperm, ovum and/or embryo. The parties further agree that they will notify the Bank of the terms regarding the use of the sperm, ovum and/or embryo by letter in the form annexed hereto. Unborn Issue; Disposition of Pre-Zygotes The parties, having arranged for storage of their pre-zygotes, understand that their pre-zygotes will be stored for a maximum of five (5) years. They agree that the frozen pre-zygotes will not be released from storage for any purpose without the written consent of both parties, consistent with the policies of the in vitro fertilization program (IVF) and applicable law. After the five-year period or the date of divorce of the parties, whichever shall occur first, the frozen pre-zygotes may be examined by the IVF Program for approved research investigation as determined by the IVF Program. Unborn Issue; Frozen Sperm Cells to Remain Active The parties acknowledge that during their marriage they have placed into storage in a medical facility (the "Bank") maintained and operated by (name of institution), frozen spermatogonial stem cells to insure that the parties could be parents in the future. The sperm stem cells are currently held in a frozen state. The parties agree that based upon their marital difficulties, the sperm stem cells shall remain active and frozen unless the parties shall mutually agree in writing as to how the sperm stem cells shall be disposed of. Unborn Issue; Ordered Destruction of Frozen Sperm Stem Cells The parties acknowledge that during their marriage they have placed into storage in a medical facility (the "Bank") maintained and operated by (name of institution), frozen spermatogonial stem cells to insure that the parties could be parents in the future. The sperm stem cells are currently held in a frozen state. The parties agree that it is our mutual request and intention that the sperm stem cells presently frozen shall be destroyed under supervision. This provision is irrevocable authority to the Bank to destroy such cells. In the event of non-compliance with this request. either party can submit an ex parte order to a court of appropriate jurisdiction directing the Bank to destroy said sperm cells. Upon such destruction, the order shall provide that the Bank shall give written communication to both parties certifying that said destruction has taken place. In the event for any reason whatsoever said sperm stem cells are utilized to provide sperm that results in the birth of any child or the birth of a child not alive, the parties agree that the Husband shall have absolutely no obligation for support, medical bills, maintenance or to supply any money whatsoever for the benefit of or on behalf of either the mother, regardless of her identity, or the child.
