In consideration of these services and as an express condition thereof, Owner expressly waives any and all claims for damages against Sitter (unless arising from intentional misconduct or gross negligence on the part of Sitter) with regard to the following:A. Damage to lawn, plants, or any outside furniture;B. Damage to indoor or outdoor plants; C.The loss of any trash or recycle receptacles due to wind or any act of nature; or D.Damage to House of any nature. 4.In case of an emergency such as a fire, water leak, or gas leak, Sitter has the right to arrange for qualified persons to fulfill contract responsibilities for repairs. Sitter will notify Owner as soon as possible of the emergency. 5.No pet sitting will be provided for in this contract. If pet setting is needed, a separate contract or an amendment to this contract must be executed by both parties.6.Owner hereby authorizes Sitter to immediately deal with any emergencies that may arise in the manner that Sitter deems most effective in protecting life and property. An emergency is defined as a sudden, urgent, usually unexpected occurrence or occasion requiring immediate action. 7. Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute.
