Lease of Storage Space for Household Goods Lease Agreement made on the _________________________________________ (date), between ______________________________________________________ (Name of Lessee) of ___________________________________________________________________________ ______________________________________________________________________________ ________________________________ (street address, city, county, state, zip code) , referred to herein as Lessee, and __________________________________________________________ (Name of Lessor), a corporation organized and existing under the laws of the state of ____________________________________, with its principal office located at ______________________________________________________________________________ ______________________________________________________________________________ _________________________________________ (street address, city, county, state, zip code) , referred to herein as Lessor. Now, therefore, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Lease of Storage Space Lessor does hereby lease to Lessee and Lessee does hereby lease from Lessor, Room No._________________, consisting of ______________________square feet of storage area, in Lessor's warehouse at ___________________________________________________________ ______________________________________________________________________________ __________________________________ (street address, city, county, state, zip code) . 2. Rental Lessee shall pay as rental for the storage space $_______________________ per month payable, without demand, in advance on the __________day of each month commencing ____________________________________________ (date) . 3. Purpose of Storage Room No. _____________________ shall be occupied by Lessee for the storage of furniture and other household goods, and for no other use or purpose, subject to such regulations as Lessor may make respecting the room and its use. 4. Responsibility of Lessor Lessor shall exercise proper diligence in preventing access to the room by unauthorized persons, but Lessor otherwise assumes no responsibility with reference to the contents of the room. Goods of Lessee in the warehouse but not placed in Room No._________________ shall be subject to warehouse charges and rules while remaining in the custody of Lessor. 5. Access to Premises Lessee shall be entitled to access to the room [e.g. on Monday through Friday at (time) to (time) and (time) to (time), with no access on Saturdays or Sundays] __________________ ______________________________________________________________________________ ______________________________________________________________________________ ______________________________________________________________________________ _____________________________________________________________________________ . Access by Lessee to the room must, in each instance, be in the presence of an employee of Lessor, and the usual warehouse charge for such access shall be paid. Lessee shall have exclusive control of the room, its contents, and the keys of the room. 6. Perishable or Hazardous Goods No perishable or hazardous goods shall be placed in the room by Lessee. On default in performance of this section, this Lease shall terminate at the option of Lessor; and Lessee shall be responsible for all damages sustained by Lessor by reason of such default. 7. Assignment or Sublease This Lease shall not be assigned nor the room sublet without the written permission of Lessor. 8. Limitation of Liability In consideration of limitation of the rental under this agreement to the above specified amount, and after Lessee has been given the opportunity by payment of a higher rental to avoid such limitation of liability, the liability of Lessor for loss or damage from any cause in moving or handling any property to, from, or in the room shall be limited to $_____________________ for each piece or package and their contents. 9. Default in Rent In the event of nonpayment when due of any installment of rent, access to the room may be refused to Lessee until such rent is paid in full. All property remaining in the room shall be subject to a warehouseman's lien for the amount of rent in arrears. The lien may be enforced in the same manner as is provided by the law relating to warehouse storage, generally. Lessor may have access to the room by breaking into it or otherwise for the purpose of enforcing the lien. Instead of immediately enforcing its warehouseman's lien on nonpayment, Lessor may store the property at the expense of Lessee, who shall become liable for the usual storage charges. The storage charges shall be subject to Lessor's warehouseman's lien as they may accrue. 10. Termination of Lease This Lease may be terminated by either Lessor or Lessee on _______days' written notice to the other party. On termination of the Lease, Lessee shall surrender to Lessor the keys to Room No. __________________. 11. No Waiver The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred. 12. Governing Law This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of ____________________________________. 13. Notices Any notice provided for or concerning this Agreement shall be in writing and shall be deemed sufficiently given when sent by certified or registered mail if sent to the respective address of each party as set forth at the beginning of this Agreement. 14. Mandatory Arbitration Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. 15. Entire Agreement This Agreement shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding upon either party except to the extent incorporated in this Agreement. 16. Modification of Agreement Any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by each party or an authorized representative of each party. 17. Counterparts This Agreement may be executed in any number of counterparts, each of which shall be deemed to be an original, but all of which together shall constitute but one and the same instrument.
