RELEASE FOR DAMAGES (Drilling Operations) State: County: Landowner: (Name and Address) Lessee: (Name and Address) Effective Date: For adequate consideration received from Lessee, named above, deemed by Landowner, named above, as full payment in settlement and satisfaction of all detriment, injuries, and damages of whatever nature, character, or kind, arising out of, incident to or in connection wi th Lessee's operations in the drilling of a well and the construction and/or laying of lease roads, flowlines, electrical, and all other lines on the following lands (the "Lands") in the county and state named above: (Description of Lands on which Well is Drilled) Landowner releases and discharges Lessee and Lessee's successors and assigns from any and all claims for detriment, injuries, damages and losses of whatever nature, characte r, or kind which Landowner has or may have sustained by reason of the drilling of a well by Lessee and/or the construction of or laying of lease roads and lines on the Lands, all in connection with the production and sale of oil and/or gas produced from the Lands. For the same consideration, Landowner covenants and agrees to hold Lessee, and Lessee's successors and assigns, harmless from and against any and all claims and/or dem ands of any party, whether Landowner's tenants, employees, successors, or otherwise, who may have or claim to have any interest in the Lands, improvements on the Lands, grass, vegeta tion, flowers, shrubs, trees, crops, livestock, or other personal property growing or located on the Lands, including the pollution of any water located on, in, or under the Lands, which claim and/or demand may arise, or have arisen, out of Lessee's operations and activities on the Lands at any time prior to the Effective Date of this Release. This Release is signed by Landowner as of the date of the acknowledgment below, but is effective for all purposes as of the Effective Date stated above. Landowner
