- 1 - CONSTRUCTION CONTRACT THIS CONSTRUCTION CONTRACT (“Contract”), effective as of the date of the last party to sign below, is between , having an address at ("Contractor") and , having an address at ("Owner"). For valuable consideration the parties hereby agree as follows: 1. SCOPE OF WORK: Contractor shall provide all labor and materials, and perform all work necessary for the completion of the residence, structure, or improvements as described in the drawings and specifications signed by both Owner and Contractor (“Project”) and more particularly described as Such drawings and specifications are hereby made a part of this Contract. Drawings and specifications shall contain a scale drawing showing the shape, size, and dimensions of the construction and equipment together with a description of the work to be done, materials to be used, and the equipment to be used or installed. 2. WORK SITE: The Project shall be constructed on the property of Owner located at and more particularly described as (hereafter "the Work Site"). Owner hereby authorizes Contractor to commence and complete the usual and customary excavation and grading on the Work Site as may be required in the judgment of the Contractor to complete the Project. Unless called for in the drawings or specifications, no landscaping, finish grading, filling or excavation is to be performed at the Work Site by the Contractor. 3. TIME OF COMPLETION: Contractor shall commence the work to be performed under this Contract on or before and shall substantially complete the work on or before . Contractor shall not be liable for any delay due to circumstances beyond its control including strikes, casualty, acts of God, illness, injury, or general unavailability of materials. 4. PERMITS: Contractor shall apply for and obtain such permits and regulatory approvals as may be required by the local municipal/county government, the cost thereof shall be included as part of the Project pric

Payment: contractor shall pay to owner the amount of the costs of the construction (the cost for which the contractor shall be reimbursed as provided herein) in cash or a cashier's check as soon as such compensation is realized by contractor or the payment has been approved by the local governing body, or by payment in two equal installments. 6. Deposit: there shall be placed with the company or incorporated association providing and executing the contract a cashier's check of sufficient amount, the sum of which is sufficient to cover the costs of construction, which check shall be signed by the owner, to remain in trust or investment account, for thirty (30) days. The balance of the payment shall be made at the time of closing or at any time thereafter by certified check, bank draft, or bank check, or by deposit in an interest bearing account with a bank of the principal business of the account. The original contract shall not set forth any security interest in which the construction obligation may be encumbered at the time of completion of construction. 7. Final inspection: upon the completion of construction, both the owner and contractor shall, together with the contractor's invoice, permit, or other document evidencing completion for the work site shall, not later than thirty (30) days after completion, submit to the local governing body a final inspection report, and if, at the time of close of business one (1) year passes from the date of receipt of materials or work site, the owner shall, within fifteen (15) days after request of the local governing body, post the final inspection report and invoice to the inspection booth of the local governing body and shall also post and attach the materials and other related documents to each room in the same manner provided herein (“document”) and any other material or materials needed to complete construction, which will be held at the premises of owner for inspection by any member of the public to a minimum of once a month for a period of five consecutive business days.
