Settlement Agreement Between Husband and Wife Settling Property Dispute and Future Property Rights This Settlement Agreement is made on the __________________ (date) , between ____________________ (Name of Husband) of _______________________ ________________________________________________ (street address, city, state, zip code) , referred to herein as Husband , and __________________ (Name of Wife) , of ______________________________________________________________ __________ (street address, city, state, zip code) , referred to herein as Wife. Whereas, a dispute has arisen between Husband and Wife as to the property rights existing between them relative to the following-described property: (describe) ______________________________________________________________________ _____________________________________________________________________ , and all other property owned by either or both of them; and Whereas, Husband and Wife, in settlement of the dispute, have entered into this Agreement for the purpose of finally determining the rights of each as to all of their property and as to the obligations of each toward the other; Now, therefore, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Parties to Live Together; Support by Husband Husband and Wife agree to continue to live together as Husband and Wife, and Husband assumes his obligation to support Wife so long as Husband and Wife continue to live together and do not separate. 2. Payment by Husband Husband agrees to pay to Wife $____________ on or before _______________ (date) . 3. Mutual Release and Discharge Husband and Wife each forever release and discharge all of his or her right, title, and interest in any property owned by the other, or which the other might acquire by reason of the marriage, and any dower or curtesy interest, or any other interest that each has, or will have, by reason of the marriage, in the property of the other. 4. Expenses for Medical Care If Wife is required to secure hospital and medical treatment for any illness from and after this date, the expense shall be paid by Wife from her own funds. If Wife shall predecease Husband, the funeral expenses of Wife shall be paid from the funds and the estate of Wife, and Husband shall not be liable for the payment of the same. Similarly, if Husband is required to secure hospital and medical treatment for any illness from and after this date, the expense shall be paid by Husband from his own funds. If Husband shall predecease Wife, the funeral expenses of Husband shall be paid from the funds and the estate of Husband, and Wife shall not be liable for the payment of the same. 5. Disposition of Property by Descent or Will All of the property, real and personal, of which Husband may die seized or possessed, shall pass to and descend to his children, or as he may direct by will, without right or claim made by Wife as surviving Wife. All of the real and personal property of which Wife may die seized or possessed shall pass to and descend to her children, or as she may direct by will, without any right or claim made by Husband as surviving Husband. 6. Effect of Separation or Divorce If it develops that the parties cannot continue to live together as Husband and Wife and a separation is desired or effected, then each of the parties shall be obligated to support himself and herself. If a divorce or dissolution of marriage proceeding shall be commenced, Wife shall not be entitled to any interest in the real or personal property of Husband, nor shall Husband be entitled to any interest in the property of Wife, and Husband shall not be obligated to pay alimony or attorney fees for Wife.
