- 1 - PREMARITAL AGREEMENT READ BEFORE SIGNING: IMPORTANT NOTICE: EACH PARTY TO THIS AGREEMENT AGREES THAT THEY HAVE HAD AN OPPORTUNITY TO CONSULT WITH AN ATTORNEY OF THEIR CHOICE LICENSED TO PRACTICE LAW IN THEIR STATE OF RESIDENCE (NOT THE SAME ATTORNEY) AND THAT HAVE FULLY READ, UNDERSTAND AND AGREE TO THE TERMS OF THIS AGREEMENT. EACH PARTY FURTHER AGREES THAT THEY ARE NOT ACTING UNDER DURESS OR UNDUE INFLUENCE IN EXECUTING THIS AGREEMENT AND THAT EXECUTION OF SAME IS DONE FREELY AND VOLUNTARILY. THIS AGREEMENT, made this ____ day of ________________, 20____, between ___________________________ (Name), of ______________________________ (Address), _____________ (State) ("first party or Wife"), and _____________________ (Name), of ____________________________ (Address), _____________ (State) ("second party or Husband"), W I T N E S S E T H WHEREAS, Husband (check all that apply): has previously been married; has a child or children; has not been married; and Wife (check all that apply): has previously been married; has a child or children; has not been married. The parties desire to enter into this agreement prior to their contemplated marriage. WHEREAS, the parties hereto have accumulated separate estates; and WHEREAS, the parties are about to contract marriage and execute this agreement in contemplation of marriage to be effective upon their marriage in accordance with the laws of the State of Wisconsin, including any Uniform Premarital Agreement Act, or other applicable laws, adopted by the State of Wisconsin; and WHEREAS, the parties desire to enter into an agreement regarding certain properties, responsibilities, duties and obligations including but not limited to any interest, present or future,
(name), of (address), (state) ("first party or wife”), is planning on having an agreement entered into regarding her interests and responsibilities regarding the following: estate taxes, wages (including but not limited to unemployment compensation) and any other liabilities. Wives (check all that apply): agrees to pay each party (check all that apply) a minimum of ten percent of her average monthly remarriage annual income or gross monthly premarital income after expenses for her support until her death, and to contribute all the party's reasonable and necessary medical expense, including, but not limited to any costs associated with the initiation of a paternity test, any cost associated with the filing of any paternity action, any cost to raise children, medical insurance coverage or cost for care of children during the marriage or after the breakup of the marriage, for the support of her children and if such party was not married to the other party at the time of the dissolution. In addition, the parties desire to make certain co-parenting arrangements for at least the child(men) of each party, which may include, without limitation, providing for: the parties' visitation and physical custody of the child(men) as applicable; the provision of child support payments; and the provision of assistance to the child(men) related to education or other necessary expenses incurred as long as both parties agree to participate in any such co-parenting arrangements. For these reasons, the first party or wife desires to include, among other things, a premarital agreement with respect to the parties' premarital property. She further desires that the premarital agreement be in writing and delivered to each party at close of business on this day of 20, 20, in the presence of counsel at (name) and (address).
