No. _______________________________________ * * Petitioner,*JOINT MOTION TO WAIVE *FINANCIAL STATEMENTS* and AND CONCERNING *FOR COURT TO ENTER________________________ *DECREE WITHOUT HEARING * Respondent. *COMES NOW the above named parties, and jointly move the Court as follows: 1.Iowa Code §598.13 states that the parties may waive the requirement of filing financial statements upon application of both parties and approval by the Court. The parties have entered into a Separation and Property Settlement Agreement disposing of all property and debts of the parties, and are confident that this Agreement fully addresses all property and debt issues. Said Agreement is attached to the petition in this case, as Exhibit “A”. The parties would therefore prefer to forgo the filing of financial statements and ask that the Court waive this requirement.2.Iowa Code §598.8(2)(a)(1) states that the Court may enter a decree of dissolution without a hearing if all of the following circumstances have been met:(1) The parties have certified in writing that there has been a breakdown of the marriage relationship to the extent that the legitimate objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved.(2) All documents required by the court and by statute have been filed. - 2 - (3)The parties have entered into a written agreement settling all of the issues involved in the dissolution of marriage.(4) There are no children of the marriage for whom support, as defined under Iowa Code §598.1, may be ordered.The parties submit that by virtue of the statements in the petition and answer, the other filed documents, the written agreement attached to the petition, and the fact that there are no children of the marriage for whom support, as defined under Iowa Code §598.1, may be ordered, that the above circumstances and conditions are met in full and that the Court may therefore enter a decree of dissolution without a hearing. WHEREFORE, the parties jointly move the court to grant the following relief: 1.That the requirement of filing financial statements be waived, and2.That the Court enter a Decree of Dissolution without a hearing.
